Data Protection and Public Interest test are being used against us to help Crown Office hide statements and documents pertinent to appeals when in reality we should be asking for documents in the public interest.

It is in the public's interest that justice is seen to be done and when Crown withhold evidence this is not in the publics interest.

Remember also that the documents asked for will already have been used in criminal trials therefore already in the public domain thus rendering the public interest and data protection incompetent for withholding this evidence.

We are being told that the evidence sought was already released to the defence teams at the time of original trial thus rendering the tests incompetent again, but Crown are still withholding evidence they deem already released, What a joke.

I am interested in hearing other cases wher this is being used to obstruct justice.

Dear Wullie and All Readers.

Couldn't agree more. This is exactly what is happening in my daughter Annie's case. In accordance to the FOI I have been asking for the documentation in my daughter's case several times, however Crown Office is refusing to give this to me since they claime my daughter's death is not in the public interest!

Well, I am not the public, I am her mother, and regarding the public interest, today there have been more than 18500 visiters to Annie's web-page annierockstar, people writing about their concern in the Guest-book and to us privately, numerous newspaper articles, TV episodes and so on. Then what is ment by public interest? Please reply to that Crown Office!

How many more inhumanly treated cases do we have to be before there will be a correction of this defectively consructed law, and how many are we now,  mistreated by the legal system? The very same legal system the is actually ment to SERVE the people!

Looking forward to an overhaul of the entire Justice system, and very much forward to The Justice Conference - Agenda for Change this year initiated by Mr. McKie, hope this will be a good starting point for a serious discussion and true changes. The Scottish people is worth that!
