Judge pornography scandal: Criminals could seek to overturn convictions

Judicial Conduct Investigations Office says four judges have left their roles after being caught watching sex movies on court computers

Criminals could seek to have their convictions overturned after judges were caught watching pornography on court computers.

Three judges have been removed from office and a fourth resigned over the scandal, it emerged, just weeks after the most senior judge in England and Wales told MPs of his grave concerns over internet pornography.

The Judicial Conduct Investigations Office (JCIO) refused to disclose whether the four male judges – who worked in criminal, county and immigration courts – had been viewing the indecent material during hearings or elsewhere in court buildings.

If it emerges the judges were distracted from key evidence because they were surreptitiously watching sex films, defence lawyers could lodge appeals asking for convictions and other judicial decisions to be overturned.

Lord Thomas of Cwmgiedd, the Lord Chief Justice, and Chris Grayling, the Lord Chief Justice, examined allegations against the men and condemned their behaviour as “wholly unacceptable”.

The material viewed did not include images of children and was not illegal, a spokesman added.

But he refused to disclose any further details, such as how the scandal came to light or how long it had been going on.

District Judge Timothy Paul Bowles, immigration judge Warren Grant, both from London, and Deputy District Judge and Recorder Peter Bullock, who worked in the North East, were removed from office.

A fourth man, Andrew Maw, who sat at Lincoln County Court, was also found to have viewed similar inappropriate material on his judicial IT account.

The judge had worked as a recorder, or part-time judge, from 2000. He dealt with civil and family cases, plus criminal cases in the Crown Court.

Mr Maw, 65, who lived in Humberston, Lincs, until last summer, resigned before the investigation could be completed.

A spokesman for the Law Society, which represents more than 100,000 solicitors in England and Wales, said: “It depends entirely on the facts which emerge about the exact circumstances, but solicitors representing clients will be interested to establish whether there are grounds for appeal.

“Hopefully more information will emerge in the coming days.”

The cases were not linked and are understood to have taken place at different times and places.

A JCIO spokesman said: "The Lord Chancellor and the Lord Chief Justice were satisfied that the material did not include images of children or any other illegal content, but concluded that this was an inexcusable misuse of their judicial IT accounts and wholly unacceptable conduct for a judicial office holder."

The scandal comes just weeks after Lord Thomas said internet pornography was causing rapists and murderers to commit worse crimes than before the time when such “horrific” material was available online.

One of the judges said he had been suffering from depression at the time of the allegation.

Mr Grant, who now works as an immigration law specialist at a firm of north London solicitors, said: "I do not wish to comment save to say that for some years before, and during, the period covered by the conduct which formed the subject of the complaint laid against me I was suffering from severe and undiagnosed depression.”

Father-of-five Mr Grant, of Golders Green, north London, was educated at the Royal Newcastle Grammar School and Cambridge University, and has an interest in jazz.

In 2005 Judge Bullock was involved in a prominent case at Newcastle County Court when Jimmy "Five Bellies" Gardner - a close friend of Paul Gascoigne, the England footballer - was declared bankrupt.

Former neighbours of Mr Maw in the upmarket village of Humberston said he moved away about seven months ago.

The elegant detached house with a long drive is believed to have been sold.

One neighbour said "We knew he was a judge. He has been gone about seven or eight months but we didn't know why he left.”
