Justice Committee To Look At SCCRC

In an e-mail today in answer to my 11 page dossier sent to the justice Committee I am informed my complaints will be placed before the board for consideration:

Dear Mr Beck,

Thank you for the e-mail, and apologies for the delay in responding.

The Committee is due to consider its forward work programme at its meeting on 22 September.  In doing so, it will consider a paper outlining various options for work that it may take on.  I propose to include a paragraph in the paper for that meeting referring to your suggestion of an inquiry into the powers, responsibilities, operation and funding of the SCCRC.  I will mention in that context the issues you mention about alleged inconsistency in the SCCRC's approach to different cases, and whether this amounts to a restriction on access to justice or a breach of ECHR.

I will let you know after that meeting the outcome of the Committee's consideration of the suggestion.

This is what the forum is all about. Supporting those who through hard work and persistence succeed in getting the Justice System’s ear.

The idea of a ten year review of the SCCRC is an excellent one and does not I believe act as a cover for any negative criticism of the organisation. It is one of the most important justice organisations around today and is often the last realistic hope we have of obtaining justice.

Their Willie Gage and Al Megrahi  decisions show us that seeking to build their strength is so much better than seeking to bring them down.

I also feel that this achievement should serve as a reminder to those of us who get caught up in gratuitous personal insults and destructive comment  that the way forward is intelligent, constructive argument backed up with suggestions how to bring about change.

As I have said before the system loves the obsessives who they are easily able to marginalise and write off. They have much more difficulty with logic, courtesy  and determination.

So many contributors to this forum exhibit these qualities and this is to their eternal credit.

I just want to take this opportunity to thank you all for your kind words.

It is to be hoped that the SCCRC will take on board the criticisms in my 11 page document and learn from any mistakes they may have made.

I have submitted a number of cases I think SCCRC dealt with badly including Edward Milne's, Edinburgh Three, Wullie Gage, Megrahi, Jocky Robertson and others including my own, and claim they are similar to others referred by SCCRC and in some cases lack investigation denying people fair hearings.

Another criticism was the fact they asked for expert opinions in some cases and nopt in others with the same issues.

Like Iain I think SCCRC are a much needed organisation for those seeking Justice and I would never advocate they be shut down.

However there needs to be change, and to a great extent we are already seeing this change take place in the case Mentioned by Iain Wullie Gage,
The SCCRC refused two years ago to refer this case back to the appeal court yet after further submissions changed their minds.

There is still the same problem of having to point out to the Commission that wait a wee minute you have referred this case on similar grounds, How can you refuse this one ?

Their legal officers should be able to see the problems and see they are similar to one's already referred.

In Razza For Judicial Review they sought and gained the power to refuse to refer a case where Prima-Facie Arguable & Competent grounds exist, when our High Court would be duty bound to accept them for review.

This I am arguing is perverse and totally against everything SCCRC stand for, and why after all would an organisation set up to cure Miscarriages want such powers in the first place ?

It is a nonsense to suggest they only refer a case where they Think there has been a Miscarriage.

Recent referrals show when no grounds exist cases will be rejected by our Courts so why would SCCRC reject a case with Strong Grounds.

At their conference Peter Duff claimed they refused to refer a case with Very Strong Grounds because they knew the person was guilty but how many cases will pop up like this where they can say without any shadow of a doubt the person is guilty.

Other members of SCCRC will claim it is very dangerous to decide if someone “Is or Is Not Guilty” because then they would be acting as Judge Jury and Executioner.

This is not a power I think Parliament thought they were bestowing upon SCCRC when they brought them into being under section 194 of the 1995 act, Parliament would be the only ones able to change this Perverse act which is denying others access to Justice and acting Incompatible with their section 6 and their right to fair hearings.

For this reason we need our MSP's to act on our behalves.

For these reasons I also strive to make SCCRC more consistent in their referrals.

Once again many, many thanks for the kind comments and support which believe me drives me on.

Fair Hearings and Appeals for all is a must.
