SCCRC IS NOT A PUBLIC AUTHORITY, OOPS, YES, YOU ARE!In current legal proceedings, the SCCRC have responded by stating they are NOT A PUBLIC AUTHORITY FOR THE PURPOSES OF THE HRA'98 - They immediately changed position on receipt of the following response:-
"Within the response by Defender 1 to the Scottish Human Rights Commission Consultation Paper this public body has responded on points ‘material’ to its function which includes, “The SCCRC is a PUBLIC AUTHORITY and as such it would be open to applicants to allege that the SCCRC had violated human rights in the determination of an application to the SCCRC…The SCCRC believes that a decision on human rights issue in a criminal case may impact on civil law. An example of this is the decision concerning temporary sheriffs. in Starrs v Ruxton 2000 J.C. 208..” The aforesaid SCCRC submission on human rights is at complete odds with their ‘answers to the initial writ’, which claims they are not a public authority in such human rights context."
In response to an approx. £695,000 DAMAGES WRIT, founding upon their breach of duty, malpractice and gross negligence in public office, it is incredible they do not even know they are a public authority or is this just another deceitful attempt not to be accountable?!
