[Hello everybody i am a new member , I was introduced to the site through a meeting with "Big Wullie ". We have both spent the last 2 days at the High Court in Edinburgh listening to ,amongst many other things a very long and articulate presentation on the subject , or lack of Disclosures and how the are handled very successfully in England and other E E C Countries,.Unfortunately there was not enough time to complete the subject and it has been put back to a date in early November to hopefully finalise the subject of Disclosures once and for all. I cannot make up my mind whether i was witnessing a set of legal arguments or " a Whitehall Farce " a lot of these situations are new and perhaps allien to me but within two visits to this Court i have been astonished by the lack of control the Senior People in these situations ie the Judges have. indeed i have been disgusted by the lies coming from the Crown representatives How can they get away with it ?

YES Big Mac,
if the crown think that all the men up for discosure are guilty what have they to hide.

who is to say the crown will not put back further, the pain of the innocent.

the truth will out, and disclosure will have to be given even if it means going to the house of lords.

Nice to see a new face appear and great to have you on board these forums where you will be able to debate in a whole host of issues as well as express your own views and open your own debates.
I hope you will visit our call for issues to be raised at such conference in 2008 and contribute what you feel must be done to resolve the current amount of Miscarriages now coming to light.
I note you say: You are astonished by the lack of control the judges have over these matters, Please do not be fooled....... The Judges have more powers than you think.
They have the Power to demand Crown hand over these documents etc that are sought by defence teams by the flick of their hands.
Please do not forget these Judges do work hand in hand with Crown Office, After all they are part of them, At least part of Justiciary.
What we need is for Crown to be held accountable for cases like Kidd, Gair, Allison and Johnston not to mention Campbell And Steele and the many more cases now surfacing.
In nearly every Miscarriage now coming to light Crown Have been found to be in breach of their Human rights by not revealing Key evidence at the time of trial.
Some cases are also coming to light that have been dealt with poorly by their defence teams at the time of their trials.
It is also evident that when someone is not happy with their original defence team and sack them they experience great difficulty in finding other Lawyers to take on their cases.
I know this to be the case in my own situation as well as your own.
Hopefully these issues will now be addressed and we can bring these matters to bear at any conference along with all the other isssues being raised.

I have just spent the last two days on a follow up to the two day hearing in August relating to Disclosures .There were eight people involved looking for disclosures . At the last hearing it was decided that as there were four prisoners present in court they would discuss these four on a general basis and the other four would have the same decision on their petition,,,,,,It was very apparent that the Crown was taking this very serious as the Attorney General was present,,and the Crown presentation was made by the Lord Advocate Elish Angelino herself. Seven of the eight were looking for complete disclosures and one ( my nephew Gavin Grant )was looking for specific disclosures . Prior to the hearing beginning Gavin,s Q C was promised the outstanding disclosures he requested would be supplied and his petition was withdrawn and Lord Hamilton said he should apply for his appeal date "expeditiously (amazing how all of this happened following Lucy Adams report in the Glasgow Herald ) we wait with baited breath to receive the promised disclosures !
The original presentation by Chris Shed QC was on a general basis as instructed by the Judges Lords Hamilton. Nimmo Smith and Philip
When the Lord Advocate made her presentation she stated that disclosures were being supplied as requested and in line with article six, and had been for the last eighteen months ( other world springs to mind )....She also tried to bring in specific petitions ,but was overulled and asked to keep to the general principle. Mr Shed had an opportunity to reply to all of her points ,and gave a very good account in my opinion.
The Attorney General made his presentation to the Court and again Chris Shed had a go at his presentation also .
The first day started very positive and by the end of the day i was of the opinion that we would get disclosures as requested.....by the close of play on day two i am not so sure as the day was closed sharply with Lord Hamiltons uttering of AVISANDUM. which as we know means that they are taking time to consider their judgement and will reply in writing .........so after four days we still dont have an answer ..My opinion is that disclosures will be given ,with the subject of who controls the supply being the very decisive point,if it is the Crown we will be back to square one, but we must wait and see

Thanks for the update on the disclosure cases, I am sure all will turn out right, Chris Shead will not accept anything else, he knows his stuff.
AVISANDUM as we know can take months but usually is only a couple of weeks, i will be watching for this case with interest.
To let everyone know my computer was down for two weeks there hence the reason "Not too many Posts"

WULLIE IF DISCLOSURE IS NOT RELEASED I WILL START GIVING NAMES OUT AND SEE WHAT THEY ARE ALL ABOUT!

I WILL PUT POSTERS THEN MORE POSTERS AND CHRISTMAS CARDS ALL IN GALSTON .

Hi matt visited Brenadan today and found out somethings about the disclosure.
mr shead asked .

A, why, third acussed was FOUND NOT PROVEN?
B, statement from someone i will not say the name "who gave four statements last one just before trial" being hidden!
C, what have the witnesses in the case got to hide why are the crown covering for them?

i know of cases pending but that was two years ago!

the lord advocate seems to be passing the buck again!
