Does this mean Megarhi can now appeal under section 92 and 6,1&3 of the human right to a fair hearing ?
The evidence hidden according to Edwin Bollier is proof that the timer was not made for Libya.
The question now is simply : Did Crown know of this evidence at the time of trial and why wasn't it released to the defence team ?

Ed Milne From Forfar submitted to SCCRC that the very same happened in his trial and he was supported by his Lawyer in that part of his trial was held outwith his presence.
Basically a Fundamental Irregularity Occurred!
SCCRC rejected this ground without further investigation Indeed they only interviewed his Lawyer.
They decided this ground would proceed no further without any mention of drummond or any case beforehand.
Mr Milne is not happy with the actions of SCCRC and is seeking to appeal directly to the appeal court as he has never had an appeal.
SCCRC should have noted he had never had an appeal and advised him to go direct to appeal courts, This is what they profess to do on their site.
Why then did they fail Mr Milne

As the world looks on it is not Mr Megrahi who is in the dock in Edinburgh but Scottish Justice.
What is happening behind closed doors is an affront to a system that professes to embrace principles of openness and accountability while it indulges in blatant self-interest.
My hope is that our Scottish judges can rise above all of this and grant the victims of this tragedy the truth to which they are entitled.
Scottish politicians, with a few honourable exceptions, should hang their heads in shame given that for nearly 20 years they have done so little to advance the cause of truth. |

I agree with your comment Iain and I would add that not only politicians should hang their head in shame, but also those members of the judiciary who were participants to what has gone on ..
Explanations should be sought but I doubt will never be gained from those who have played a major part in an injustice to the whole country, not only Mr Megrahi. _________________ My blog on issues of injustice in Scotland A Diary of Injustice in Scotland by Peter Cherbi

Hi Kevin
Thanks for posting the above letter from Jim Swire on the forum, I am guilty of not reading the letters sections.
I wish Jim and his Family all the best as the time approaches for the anniversary of Lockerbie as we will always remember it.
Sadly for Jim and his Family they will always remember it for taking their beautiful Daughter Flora.
I am sure she is looking down saying get on with your life Dad.
Sadly Jim will never be able to get on with his life unless the truth rears its ugly head, which I doubt.
As for being a credit to Truth and Justice, I do not think these words do him any credit at-all.
He is a champion among us.
Most importantly I know his Flora would be proud of the way he has acted and his stance for truth and justice
He has stood steadfast against not just our Crown Office but against the Odds, he has fought for a man he knows deep within his heart is Innocent.
For this I congratulate him and his family, If only I could give out medals !

More and more evidence is coming forward but I think we already knew about the evidence from Gauci.
After all the Americans are also alleged to have paid him £2 Million
