This Shocking case rears its ugly head again and severely taints the reputation of Northern Constabulary.
When are this poor family to have some respite?
Institutional Arrogance has no hiding place and the board of Northern Constabulary should be sacked for refusing to allow an outside force to investigate their incompetences.
In this day and age it beggars belief that they can refuse to initiate such enquiries after being found guilty of Arrogance.
Lets hope someone in authority will take heed of this case.

INCOMPETENCE OR COVER-UP ??? YOU DECIDE.
THE FOLLOWING PARAGRAPHS WAS TAKEN FROM CENTRAL SCOTLANDS CHIEF CONSTABLE ANDREW CAMERONS 284 pg REPORT REGARDING NORTHERN CONSTABULARYS HANDLING OF KEVINS DEATH AND THE FAMILYS SUBSEQUENT COMPLAINTS.NOT FORGETTING THAT THE PROCURATOR FISCAL MR MACDONALD ORDERED A "MURDER ENQUIRY" TO BE UNDERTAKEN, AFTER THE PATHOLIGIST INFORMED HIM THAT THE INJURIES KEVIN SUSTAINED WAS CONSISTENT "WITH A KICKING" RECEIVED SEVERAL HOURS "PRIOR" TO ENTERING THE WATER.
DESPITE INTERVIEWS UNDERTAKEN WITH ALL OFFICERS WHO HAVE HAD A CONNECTION WITH THE PROPERTY OF KEVIN MCLEOD THIS ENQUIRY HAS FAILED TO ESTABLISH WHERE,WHEN AND BY WHOM THE CLOTHING OF THE DECEASED WAS DESTROYED.
THE FAILURE OF THE FORCE TO SEIZE, RETAIN AND SUBMIT FOR EXAMINATION THE CLOTHING WORN BY KEVIN MCLEOD AT THE TIME OF HIS DEATH REMAINS INEXPLICABLE, ALSO THE FAILURE TO ENSURE THAT NECESSARY PHOTOGRAPHIC EVIDENCE IN RESPECT OF THE INJURIES SUSTAINED BY HIM WERE DOCUMENTED AND PROPERLY RECORDED.
IT IS THIS ENQUIRYS VIEW THAT HAD THE EXISTENCE AND SIGNIFICANCE OF THE INJURIES BEEN PROPERLY
RECOGNISED,ASSESSED AND RELAYED TO DETECTIVES AT THE TIME OF THE FIRST ENQUIRY,IT MAY WELL HAVE BEEN DIRECTED DIFFERENTLY.
WHILST IT IS NOT NECESSARILY POSSIBLE, NOR INDEED HELPFUL,TO PLACE THE BLAME FOR THIS STATE OF AFFAIRS AT THE DOOR OF ANY PARTICULAR OFFICERS OF NORTHERN CONSTABULARY,IT HAS TO BE ACKNOWLEDGED THAT THE ENQUIRY THAT FOLLOWED THE POST MORTEM FINDINGS LACKED OBJECTIVITY, CLEAR ACCOUNTABILITY AND OWNERSHIP,AND CRUCIALLY, SUPERVISION AND DIRECTION ABOVE THE RANK OF DETECTIVE SERGANT,IN ORDER TO APPROPIATELY CHALLENGE ASSUMPTIONS AND RESOLVE INCONSISTENCIES WHICH WERE APPARENT AND SIGNIFICANT.
A CHECK OF THE COMPLAINTS AGAINST THE POLICE REGISTER MAINTAINED BY NORTHERN CONSTABULARY HAS REVEALED THAT THE COMPLAINTS RECEIVED WERE NOT RECORDED IN THIS REGISTER AND THEREFORE HAD NOT BEEN LODGED AS COMPLAINTS.
SEVERAL OFFICERS DURING INTERVIEW WERE OF THE OPINION THAT ALLAN MCLEOD HAD NO LOCUS AS A COMPLAINER IN THIS CASE. IT IS THE VIEW OF THIS ENQUIRY THAT NONE OF THESE OFFICERS COULD OFFER A REASONED OR SUSTAINABLE JUSTIFICATION FOR SUCH A POSITION. |

WICK FAMILY CONTINUE THEIR EFFORTS
21 March 2008.
A Couple whose son died in Wick harbour more than 10 years ago are continuing their efforts to establish the movements of a man thought to be involved in a fight with their son.
June and Hugh Mcleod have been told the individual was seen fighting with Kevin outside the Waterfront club shortly before he came to grief.
It has been claimed that the man, then aged 27 was a serving prisoner at the time, but Mr and Mrs Mcleod believe he was on home release from Castle Huntly.
They drew a blank with attempts to find out the true position from the Scottish Prison Service ( SPS).
The SPS first claimed it did not have the relevant records, only to subsequently concede it did have them but could not release them under the Data Protection Act.
The family has now canvassed the help of two MSPs to break through the official block.
They claim to have information that the man, whom they have identified, and two others, were involved in an altercation with Kevin Mcleod outside Carters Bar, Wick, on the night of the tragedy in February 1997.
Allan Mcleod, from Alness. said the issue has festered without being resolved. |

Statement in Response to the Ruling by the Scottish Information Commissioner
Northern Constabulary is disappointed in the decision of the Scottish Information Commissioner regarding the release of the names of 29 Police Officers stationed at Wick in 1997.
Northern Constabulary initially refused this Freedom of Information Request, considering it to be exempt from disclosure in terms of sections 26a and 38 (1b) of the Freedom of Information Act 2002.
Northern Constabulary considered that the names of the police officers are personal data and that the release of the names could potentially cause distress to the officers.
Northern Constabulary, is considering the ruling and is taking legal advice. |
