I would just like to inform readers of the appointments to the new Scottish Legal Complaints Commission, which will start later this year investigating "service" complaints against the legal profession ...

The post of chairman of the SLCC has, surprisingly or not, been filled by the outgoing Scottish Legal Services Ombudsman, Jane Irvine.

I am slightly taken aback by that, as the SLSO's office has over the years, done little for client rights against the poor regulatory practices of the Law Society of Scotland.

It doesn't look like the public have been listened too much in the appointments process, but that may well come down to what one civil servant termed "massive interference from the Law Society" against the SLCC over the past year since the Legal Profession & Legal Aid (Scotland) Act 2007, was passed.

I would have to say I am rather disappointed that people who have experienced the horrors of self regulation of the legal profession, were quickly kicked out of the appointments process, apparently on demands from the legal profession itself ...

go on for years, I doubt she is that well qualified to become the new chair of what was to be a more independent complaints regulatory body .. unless of course, she plans to clean up the sins of the past, which I doubt.

Scottish Legal Complaints Commission (SLCC)

Good article peter.
If this is what the SNP call independent then we fighting for justice are doomed.
Openness and Accountability is a must and FOI requests are a must asking the fitness of the appointees.
It also seems that the end of the article suggests the Law Society will still have a say in the proceedings.

It looks to me like the SNP have either given up on the justice issue altogether, or simply fail to understand it .. of course there's always the possibility their strings are being pulled by the very legal establishment figures that such reforms will inevitably hurt ...

In any case, the way the SLCC formation process has been handled to date, does not give confidence to the public for more accountable legal services.

It may even be the case this is a warning to people simply not to do legal business  in Scotland and I do not say that lightly.

After all, if the legal services market, and regulatory side of things isn't put right, then why should people trust the legal profession with their business at all in an unsafe and untrustworthy environment where clients (both private & corporate) finances are at stake of no recompense when things frequently go wrong.

Late today, calls were being made to First Minister Alex Salmond for a fully independent investigation into the appointments & formation process of the SLCC and for the sacking of Justice Secretary Kenny MacAskill over this highly public let-down to Scotland's legal system.

The question is: Why doesn’t Salmond just sack his “Justice” Secretary who is now a huge liability; obviously in bed with the Law Society and legal establishment in Scotland, the biggest protector of sacred cows you are ever likely to encounter and, basically, as corrupt and crooked as they come?  What dirt does MacAskill have on Salmond, one wonders, that he seems powerless to do anything about this crook who thrives on injustice (and miscarriages of justice) and preventing ordinary Scots gaining access to justice by his blatant favouritism for his legal establishment cronies?

A conflict of interest “Justice” Secretary, who should never have been allowed near the Justice Department in the first place (his falsified and crooked Legal Aid claims when he was a practising solicitor being but one reason why he was the wrong man for the job), and Salmond continues to leave him at the helm.  It would appear that Salmond and the SNP are as corrupt as the last lot and just thrive on injustice...

Welcome to the Banana Republic of Jockland folks ... where power has corrupted absolutely, and two very crooked men who “rule” over us just seem to thrive on injustice.

“A government you can trust”?  Boy, was we all conned!

PS.  MacAskill is free to sue me at any time ... he knows where to reach me and what it’s all about by now…

Not one of these cases has been properly, thoroughly and independently investigated and resolved (some 7 months on from this posting) under Salmond's and MacAskill's corrupt rule.

Actually there are further developments in that one of the lawyer members appointed by Mr MacAskill is the husband of a Court of Session Judge.

The particular lawyer concerned also is heavily involved with the "Master Insurance Policy" of the Law Society of Scotland, which is one of the areas that has caused a lot of the injustice between the public and lawyers, which ultimately sees anyone who takes issue with the legal profession denied access to justice.

I would say for the avoidance of any doubt, I am only posting this topic & further information to the forum as an example of how access to justice in Scotland is manipulated & controlled by a few, against the majority.

As people who need to resolve issues of injustice for now need access to legal services, that control over access to legal services, which remains firmly in the grip of the legal establishment for now, will to a certain extent have to be broken.

There are those within the legal profession who understand that themselves, and not all of the legal profession are happy about their governing body's policy towards the rest of us in these matters. Sadly though, the new Scottish Legal Complaints Commission, as it stands, will not prove to be the representing body for the public to ensure their rights are addressed, which the public needs - and that is where campaigners such as us will have to kick in ...

I am sure, I hope at least, that when the conference starts, and more attention is drawn to these issues, the public's unrestricted right to justice should shine again in Scotland. It is our right, and our expectation as it should be every person's right and expectation, without prejudice or prevarication.

Control and manipulation by a few, Are we to be sure that Mr MacAskill knows for sure the stuff you are bringing to our attention.

For instance is he aware of the link between the High Court Judge and the law Society Lawyer.
Their independence in appointing these type of members certainly needs more investigation.
For instance who appoints these members ? and what checks are made on their independence ?
A bit like the Watson fella too ?

The Oppression Begins.

I have heard from Peter that Flickr have cancelled his account.
They have deleted all his photos without any prior warning.
Cancelled his account without any form of excuse.

I wonder if they have had any complaints? Will be interesting to see their reply to Peters request for details of why they cancelled his account.

This will not stop people like us showing the world exactly what goes on within our Judicial System etc.

There are plenty other ways and sites willing to allow the same sort of stuff and we can even open our own websites.

Oppression will never win, Everything will out one way or another.

As someone put it to me last year re MacAskill and Salmond :

Thanks also for the message on the end detailing another glorious moment in our wonderful leaders' long list of failures and self absorbed moments of utter contempt for real people. You do wonder how they sleep at night knowing they could make people's lives better or help ease their suffering but not bothering to actually do it.

I thought that remark summed MacAskill and Salmond up very well indeed.  Shame there is no-one in the Scottish media (or anywhere else it seems) willing to challenge these "self absorbed moments of utter contempt for real people" though.  Birds of a feather... ?  Certainly appears to be the case ... either that or they don't give a damn about the corrupt practices of these two "great and good" men, and their appalling inaction over the many injustices brought to their attention.

A crooked, corrupt, conflict of interest "Justice" Secretary (and his equally corrupt, "do-nothing / turn a blind eye" master) and the media continue to do sod all about it.

Looks like we are stuck with all this injustice until we can kick this corrupt lot into touch in 2011 ... or someone is brave enough to take on MacAskill and expose him for the crook and charlatan he is (ditto King Alex).

Meanwhile, Peter and his supporters will just have to keep chipping away at this crook who thrives on injustice ... until he is finally consigned to the dustbin of history where he belongs.

Personally, I think what won the day was the video of the confrontation between John Swinney and Douglas Mill at the Justice 2 Committee in the Scottish Parliament, when the Law Society Chief Executive, reported by the Herald and a few others, misled not only Mr Swinney but the Justice 2 Committee itself in its inquiry into the LPLA Bill (now passed into law).

One thing is to tell a lie on paper, and get away with it for years - as many of those who suffer injustice know very well & experience daily .. but its quite another thing to tell a lie on camera, to a now serving senior member of the Government who went the extra mile on this issue for constituents ...

I do hope with the departure of Mr Mill, the public witch hunts for particular clients or critics who dare take issue with the legal profession over regulatory policies, will come to an end, and people will be allowed to get on with their lives, properly recompensed for these sins of the past, and without having to fear the constant intimidation which has been associated with many cases which have been brought to my attention or that of other journalists over the years - just because someone disputed the quality of their legal representatives.

I trust Mr Swinney will now go that bit further, and see this issue through to the end, ensuring the pile of cases which the Law Society has deliberately mishandled, or denied people access to justice, will be resolved in some form of lasting resolution which will in itself help repair the damaged relationship between the public and the legal profession - which would be good for Scotland as a whole.
