some things to note !

TWO killers jailed for the torture and murder of a 91-year-old have been allowed to launch a bid for freedom.
Patrick Docherty and Brendan Dixon were both sentenced to 25 years after a home help found Margaret Irvine's battered body.
Her hands had been bound behind her back and a duster was stuffed into her mouth.
Now Docherty, 42, and Dixon, 39, have been given the go-ahead to challenge their convictions at the Court of Appeal.
They claim there was no DNA or fingerprint evidence linking them to the killing of the pensioner in her home in Galston, Ayrshire, in September 2003.
Their legal teams were told last week that a hearing will go ahead later this year in the Court of Session. This is the third appeal in high-profile murder cases in Scotland in the past two months.
Teenager Luke Mitchell, who was locked up for killing girlfriend Jodi Jones, and Nat Fraser, who was convicted of the death of wife Arlene, have both lodged appeals.
Docherty has 54 convictions - 14 of them for violence.
Last night, Neil McPherson, his lawyer during the murder trial, said:
"If we had a death sentence for murder in this country, I don't think the jury would have found these men guilty.
"The evidence wouldn't have been strong enough to send anyone to their execution.
"There was no forensic evidence, only statements from witnesses who said they saw Docherty and Dixon in the area at the time."
Dixon's legal firm, Edinburgh-based McClure Collins, declined to comment. The two men were sentenced in March last year.
A jury at the High Court in Kilmarnock took six hours to find them guilty.
Dixon was also convicted of attempting to defeat the ends of justice by washing his clothes and footwear in disinfectant in a bid to conceal the crime.
As they were being led away Docherty turned to the jury and muttered: "I hope you can sleep at night." Lord Hardie brought him back and added another year to his sentence for contempt.
Margaret's family are devastated
the appeal is going ahead. Her nephew Charles Keers said: "I just pray the court makes sure they stay where they belong, behind bars for a long, long time.
"Aunt Meg was burgled in July 2003 and we were terrified whoever did it would come back.
"I kept seeing Docherty and Dixon outside her house. I was convinced they were up to no good."
Last month police dismissed claims that Docherty, of Dalmelling- ton, was prime suspect in the death of Marion Ross, the OAP at the centre of the Shirley McKie fingerprint scandal.
Another man, David Asbury, 29, was jailed for life in 1998 for Marion's murder then freed after three and a half years amid a furore over a fingerprint found at the murder scene.
Ex-policewoman Shirley McKie received pounds 750,000 from the Scottish Executive after being wrongly accused of contaminating the crime scene by leaving her fingerprint.  (Newspaper report)

The Scotsman newspaper continued its regular coverage of justice issues in Scotland yesterday by publishing my letter about flawed forensics in a flawed system.

Let's hope that over the year the media in general will pick up this particular baton and press for change in our discredited system.

THINK AGAIN OVER MURDER CARDS!

THE CHRISMAS cards sent out to "thank" the people of galston for their support
of the two men convicted of margaret irvines murder were distasteful to say the least.
if these people truly believe brendan dixon and patrick docherty were incorrectly convicted,then I have no problem with them doing all they can to prove it.But they are not going to win any friends by sending out christmas cards that are clearly designed to provoke a reaction.

Why dont they take a second to think of the family and friends of the murdered woman,especially at this time of the year?
They are still dealing with her loss after all.Im sure most of the residents of Galston are satisfied that the killers were brought to justice and just want to put this behind them.

In Reply to this letter to the Standard


1-The cards were to thank the people from Galston who has contacted MOJO Scotland with new information on the case of Margaret Irvine They Were never meant to cause any discomfort to anyone especially Margaret Irvines family if the cards offended anyone I am sorry.

2-they were sent to businesses and none were sent to any homes
The cards contained a message and wishing all a happy christmas
The message just said "Thank You for all the information and wishing them a good New Year"

3-The thing is the information that I know is disturbing and 2 Innocent men spend time in jail while a killer/Killers walk the steets of Ayrshire
and also it is hard to mention certain names while I have to take a battering I can't mention names back.

The blog is yours to do as you please and then link it to the articles in the newspapers if you feel the need to, Nothing to stop you doing that.

The Allison and Johnston cases spring to mind here where the judge criticised the police conduct but, Still nothing has ever been done about the police and they continue to be scot free as the saying goes.
Absolute Immunity should be done away with for all expert witnesses giving evidence in criminal trials.
Remember these people gave evidence under oath so therefore are guilty of perjury when caught telling blatant lies.

This comment may seem subject and emotive but I need to share with anyone willing to hear. As children we are brought up in trust and believe in social norms. The Police are the good guys ,they catch the bad guys,you know the sort of stuff that TV and media reinforces every day.
The impact upon a person (in my own case my thirteen year old daughter) when she sought assistance and support from the authorities following being raped and subjected to horrific sexual abuse has left her totally mis trusting of the world. The whole concept of of forensic evidence in my child's case was a joke. She reported the bite marks on her back ,the area in which attack occurred yet the marks faded away without a medical being arranged for a year and the area in which the crime happened never being examined for Forensic evidence. See if you truly wanted to catch a criminal then you follow through the procedures at the very least!!!!! Her statement was changed to beyond recognition, papers lost and evidence on sim cards never followed through. Even a letter from another young person stating they the rapist had previously "held me down while an another adult raped me" was ignored. It is so very strange that these Police Officers are concentrated around the same area. Maybe its because they are so lacking in training it has left them unable to detect their way around lego land or perhaps that their very poor detective skills are more by design! Which begs the question to WHO are they actually policing the public or particular and important members of the public.In the scheme of things the monster that raped my child was a tiny little fish but with a lot of knowledge on other happenings on much bigger fish and life is sweet for him, safe in the knowledge he can pick and choose his victims without redress.
I dared to challenge them and the Police have made every attempt to wreck my life, my profession, my family and silence my daughter.I have some very interesting audio tapes of Police

As for the community of Wick, well reflective of the three monkeys see nothing ,hear nothing and speak nothing, cant blame them really wouldnt wish this experience on anyone.
The people of Scotland appear to have to wait decades for justice (usually when some criminal has dropped dead or at the end of their full life) Forensic evidence is helpful when used appropriately and justly , it is also helpful if actually gathered properly or at all!!!!. PF's and Police hold far too much Power and should you wish to challenge thats ok because they simply investigate themselves with the outcome always being they are Right---good system init?. As a professional person myself I recall lots of reports coming into me about child victims of sexual abuse where the Police had No further Actioned cases as the child was either a Compulsive Liar or the Child had Mental Health difficulties ,all I can comment is that there were an awful lot of mentally ill liars in one tiny area !!!and an awful lot of of Police officers with specialized forensic child mental health training in one tiny area (not).I recall forensic evidence being gathered when a youth spat on a car ummm but got a conviction for that one didn't you boys and that really made a difference!
the victims of crimes and the victims of injustice attempt to pick up the what left of their lives while the grief trauma loss and pain remains, but its all in a good cause for the criminals and corrupt can sleep peacefully knowing they have the full protection of the law!

Hinting that the Scotsman is being Governed by the Police, Lawyers and Possibly Crown Office....... What other reason would they have to remove such comments???

where is freedom of speech?

I Stand corrected they  appeared again.
