Diabolical

In this day and age (Of openness and Honesty being the policy) It is absolutely appalling that they can get away wiith this ludicrous attempt at suppression.
To sieze anyones documents without a valid reason is nothing short of Despotism.

I only hope he now files complaints against them.

INVESTIGATOR WHO ALLEGED POLICE WRONGDOING IS ARRESTED AND TOLD TO BE SILENT

The parents of murder victim Inge Lotz hired private investigator Neil van Heerden shortly after the crime. He was hired to conduct a separate investigation into the murder. As soon as the police arrested Fred van der Vyver for the murder (on the basis of evidence they themselves had fabricated), the police told Inge's parents to dismiss van Heerden. Although he had been fired, van Heerden knew Fred was innocent. He held his silence during the trial, but once Fred was found not guilty, van Heerden came forward and filed charges of wrongdoing against the police and prosecutors.

Two weeks ago, police raided van Heerden's home and seized his laptop computers, his desktop computer, and numerous files related to the Lotz murder and other cases he was investigating. Now van Heerden has been formally arrested for "perjury." His crime? -- In an unrelated case some months ago he testified to his business address while he was in the process of moving his office. The move took longer than expected. That rendered the address given in his testimony incorrect. So he was arrested for "perjury" in that case, not related to the Lotz murder. But as a condition of his release on bail, he was instructed not to talk to the press about the Lotz murder or his allegation of police wrongdoing in its investigation.

It appears that an official policy of stonewalling, coverup, and harrassing the whistleblowers has begun in South Africa to prevent the police fabricators of evidence from being brought to justice. And even though the real killers of Inge Lotz have been identified through confessions and other incriminating evidence, no announcement has been made to reoopen the investigation.

My advice to all involved in the exposure of wrongdoing by the police in South Africa is to dig in your heels for the long fight. This promises to be as long a battle as that in Scotland over the Marion Ross murder.

There are moles destroying the SAPS dam wall from the inside. Moles not satisifed with the hole that they've dug themselves into.

The gagging order is like SAPS sticking its little finger into a tiny hole appearing in the dam wall.

Soon it will require more and more fingering, in the holes appearing, to stop the force and flow of the waters of truth.

Inevitably, the damn wall will break.

Dear Truthseeker,

I hope your prediction is correct. Unfortunately, such a prediction I made almost nine years ago in Scotland has gone woefully unfulfilled. Never underestimate the lengths to which petty politicians and small-minded bureaucrats will go to protect their own little fifedoms. They will sacrifice justice and truth in a heartbeat to meet their own selfish short term goals, with no thought whatsoever of long term goals that might suit either themselves or society better. Be prepared for the long fight and do not let disillusionment force you from the arena, but also expect retaliation and vindictiveness from those who abandoned justice for Inge and, instead, sought Fred's innocent blood.

Then, dear friend, my secret advice would be to follow the latitude a third the way around the globe to the east.

Your highlighting of the above case is great for those seeking Justice and gives us all hope that there are experts out there willing at all costs to tell the truth and most importantly of all to seek the truth.

There are many many similar cases where the judges have heavily criticised the police and prosecution services but i am afraid there are not too many instances where any proper follow up has produced any charges of criminality.

Recently in the Omagh Bombing case the judge has made serious allegations against the Police and Crown Prosecution services and even accused them of trying to beef up their case with lies. See Here:

In Scotland we all know that Marion Ross's murder will never be re-opened nor re-investigated, Too many worms.
Of interest maybe to people like yourself is another shocking case in Scotland where witnesses who told lies are allowed to move to spain and others not even traced through lack of investigation, We are talking about two Policemen here:

[126] In the letter of 3 February the Deputy Crown Agent said that the procurator fiscal was satisfied that there was no intention on the part of the police deliberately to mislead him. That is not our conclusion. On the fuller information available to us, we conclude that the police deliberately misled the Crown in a serious way. The result was that the procurator fiscal, and in consequence the defence, were kept unaware of evidence having a material bearing on a vital issue. The police thereby induced the Crown to adopt the police theory of the date of the murder and to challenge the credibility and reliability of any defence witness who cast doubt on it. That, in our opinion, was grave misconduct.

Despite this these two have have never been sought to my knowledge by Crown Office yet they pursue the likes of Tommy Sheridan.

Absolute immunity for witness's who give evidence for the Crown must end

Jan Lotz, father of the deceased, said in national Afrikaans newspaper Rapport today that "regardless of the cost", he will "leave no stone unturned" before he knows who murdered Inge.

I don't agree with everything Jan Lotz says, but his quest to find the truth is a noble one.

May he also find assistance and a change in attitude from Attie Trollip and the South African Police Service.

Sorry, Truthseeker, but the future looks more gloomy all the time. Today, the police charged Werner Carolus, one of the gang who murdered Inge Lotz, with obstructing justice for confessing to the murder. See the article: http://www.iol.co.za/index.php?se...art_id=vn20080108022044832C391824

It seems that this is the police logic: Since Fred had been arrested, the confession merely made it harder to prosecute him. Never mind that Fred was at work an hour's drive away when Inge was murdered and all of the evidence against him was completely fabricated. I have seen a videotape of Werner Carolus confessing to the crime and I can tell you plainly that Carolus knew things about the scene that only a person who had been there could have known. He denied committing the murder himself, but he knew the details that had never been released to the press. But since his confession was a hinderance to the prosecution of an innocent man, Fred, Carolus now has to be punished with charges of "defeating the ends of justice." By the way, it might be worth noting that Carolus is himself now in jail for a burglary similar to the one in which Inge was killed.

No, Truthseeker, you and I and a few others may know the truth. But the South Africa Police Service (SAPS) first arrests Neil van Heerden, a private investigator who learned the truth, and now they charge the real killer with the equivalent of perjury for confessing to the murder. It seems the SAPS is more interested in covering up their own crimes than they are in solving the murder of Inge Lotz or removing the bad cops from their own force.

This cry goes out to the world: South Africa has become a police state. There is no leadership in the SAPS or National Prosecuting Authority and senior officers are running personal vendettas.

It is looking worse than ever for hopes of justice in South Africa in relation to the murder of Inge Lotz and the fabrication of evidence by South African Police Services (SAPS) against Fred van der Vyver. The following article implies that problems go all the way to the top and even bleed over into the Scorpions, a national police force that investigates crimes committed by other police.

Johannesburg - The arrest of a friend to South Africa's top policeman for murder signals a further embarrassment for the beleaguered law enforcement agencies in one of the world's most crime-ridden countries.

Members of the elite Scorpions crime-fighting unit carried out the arrest of Johannesburg businessman Glen Agliotti at dawn on Thursday for mafia-style killing of mining tycoon Brett Kebble last year.

But while the breakthrough in the case would normally have been a cause for celebration, Agliotti's friendship with national police commissioner Jackie Selebi has instead triggered calls for the top cop's resignation.

"I've never denied my relationship with Glenn. Never. It has never been a secret," Selebi told Johannesburg's The Star daily on Friday. "I don't know of his alleged criminality. He did not tell me about it."

Commentators, however, believe that not only has Selebi been hugely damaged by his ties to Agliotti, long regarded as a key figure in the underworld, but also President Thabo Mbeki's government which expressed its confidence in Selebi only last week after reports that he was under surveillance of the Scorpions.

DA calls for Selebi's head

The Mail&Guardian weekly, which broke the story of the ties between the two men, said the arrest had "opened up perhaps the biggest can of legal worms in South Africa's criminal history".

"Agliotti's arrest must come as a huge embarrassment to the police chief and to the cabinet which publicly backed him last week," added the newspaper.

Opposition parties have been quick to capitalise on the situation.

"How it is that in a civilised nation, we have a situation where a police commissioner is associated with someone whom people are referring to as a South African mafia don?" said the main opposition Democratic Alliance's shadow security spokesperson Dianne Kohler-Barnard.

The DA has called for Selebi to be axed by Safety and Security Minister Charles Nqakula, a particular whipping boy for the opposition parties since he told MPs that those "whingeing" about crime should emigrate.

A spokesperson for the minister said Nqakula had only just returned from a trip to the United Nations and was "appraising himself of the situation".

Kebble's murder was one of 18 528 carried out last year, making SA one of the homicide capitals of the world.

Flaws in the investigation of Kebble's killing may explain why only a minority of murder cases are ever solved.

Willingness to take on high-profile targets

David Klatzow, a forensic expert and private investigator who was hired by Kebble's family after the killing, said there had been a "tremendous" decline in the standard of the police's forensic work.

"The damage to the scene was so gross and the abuse of normal procedures of forensic investigations and crime scene procurement was so abysmal that it raised the question as to whether it was done deliberately in order to make prosecution's unviable," he told South African public radio.

Others noted that it was the Scorpions, SA's version of the FBI and who are answerable to Mbeki, rather than the police to arrest Agliotti.

Since its creation in 1999, the unit has shown a willingness to take on high-profile targets such as former British premier Margaret Thatcher's son Mark who was arrested for financing an attempted coup in Equatorial Guinea.

The Scorpions themselves, however, have not been immune from embarrassment. Its former deputy director and former strategic operations unit chief are both facing charges of theft, fraud, and corruption.  


Police Commissioner Jackie Selebi associated with organized crime heads who commit "hits" against their enemies? And South African President Thabo Mbeki announces his support for Selebi even after Selebi's connections to organized crime become known? These newly publicized facts lead one to consider last week's post by Hank James at the www.clpex.com "Detail Chat Board" thread on South Africa, in which Hank speculated that South Africa may be going the way of Rhodesia, now known as Zimbabwe. For those who did not read or do not recall Hank's message, he commented that Zimbabwe used to be one of the richest countries in Africa, but now is one of the poorest. It went from a peaceful country to one now ridden with crime. Millions of refugees have streamed across the border from Zimbabwe into South Africa, which has had a devestating effect on the South African economy. South Africa's crime rate has skyrocketed because of the refugees, as well.

Back to the van der Vyver case. I had the privelege of meeting Dr. David Klatzow, quoted in the above article, in his private forensics laboratory while I was in South Africa. Dr. Klatzow was very familiar with the van der Vyver case. He recounted other horror stories of bad police work that he had investigated. Dr. Klatzow was disgusted, but not surprised that the SAPS had fabricated evidence against Fred van der Vyver rather than investigate the murder and arrest the real murderer.

Also while in South Africa, I heard of "The Scorpions." It is an elite, very specialized police force that investigate crimes committed by police officers and prosecutors. There was some mention that they were aware of the fabrication of evidence by the SAPS in the van der Vyver case and, as soon as the trial was over, they were going to begin their own investigation. I had hoped that meant there would be criminal charges against the SAPS officers involved, and a reopening of Inge Lotz's murder. But there has been not a whisper of such an investigation and I am worried now that a serious investigation of the case in South Africa is even less likely than a judicial inquiry into the false evidence surrounding the Marion Ross murder in Scotland.

As a sidebar, in the planning stages is a presentation of this case at the annual conference of the International Association for Identification in Kentucky, at which the speakers would include the van der Vyvers and their lawyers as well as most of the experts who testified, including Arie Zeelenberg (The Netherlands), Mike Grimm, Paul Ryder (Great Britain), Bill Bodziak, and myself. Also, there may be a pathologist from South Africa who testified regarding the SAPS presentation in court of a "murder weapon" (hammer) that they tried unsuccessfully to substitute in court for the ornamental bar hammer they had seized from Fred.
