Next Monday 4 February BBC Radio Scotland poses the question, 'Is the current judicial system working in Scotland and if not, why not and what can be done?'
Things kick off with a trailer for the day at 8.20 am and between 8.50 and 9.30 am the 'Morning Extra with Gary Robertson' programme is devoted to the topic and will include a phone in hopefully involving Kenny MacAskill. At mid-day there will be another insert possibly involving Alex Salmond.

Please feel free to put any of the cases highlighted below to Mr MacAskill on Monday's programme.
Will be very interesting to hear what he has to say about all those well known cases of injustice during his time as an Edinburgh MSP over the past 9 years, and now as Scotland's "Justice" Secretary...
Annie Borjesson (RIP), Karen Dewar (RIP), Craig Gowans (RIP), Annie Davies (RIP), Kevin McLeod (RIP), Mr X abuse and neglect scandal / cover up (which MacAskill and Salmond are burying at SNP HQ, and have done for years now), Peter Cherbi, William Beck, Brendan Dixon (Free the Killie 2), Al-Megrahi / Lockerbie, Shirley McKie, Kerelaw (child abuse and neglect scandal), SCCRC and Crown Office dubious decisions / lack of disclosure and devious practices...... the list is endless where fine actions have been glaringly lacking.

The recent non disclosure in the Brendan Dixon appeal shows our system up for what it is?
Even more so the fact that they are refusing to air in public their opinion for the refusal to allow Counsel to take the case to Privy Council.
It beggars belief that this opinion is withheld blocking any further appeal against this.
My understanding in all cases is this:
Anyone who appears in court for any reason is therefore entitled to see the minutes and or Interlocutor, These basically all now come by way of tape recordings.
Brendan Dixon is entitled to see or hear these make sure he asks.
Under Holland And Sinclair which our courts are bound, full disclosure must be made to the defence teams at every trial and not just Exculpatory evidence.
Are they afraid to get their knuckles wrapped again? Then why not conform and allow disclosure.
By refusing this disclosure our courts are also in breach of sections 6,1 & 6,3 of EcHR our rights to a fair hearing. Equality of arms is a must.
Will our justice Minister (Secretary) now make sure our Courts abide by the Law ? |

Hi Iain, Al & Big Wullie
Thanks for the info on the BBC Radio programme.
Garry Robertson does a fine show - I once was on it myself in 2001 to discuss complaints against the legal profession, facing two members of the Law Society who gave a less than convincing performance to their argument all was well.
I hope the programme goes well and all take part with questions etc.
All the best, and well, at least for my opinion, the Justice system certainly, and sadly, is not working - and the people who are there with the responsibility to make it work, are not currently doing a very good job of it at all.
Where there is a will, there is a way - what we need in Scotland just now is a will to resolve injustice ...
We have the will, so why don't the politicians share it ... Very well put as ever Peter.
Perhaps that's one Mr Robertson (and the UK-wide media in general) might like to put to Mr MacAskill ... should he appear, that is?!
A reminder for you Mr MacAskill ... though i'm quite sure you are fully aware of each and every one of these cases by now ... some a bit more, and a little longer, than others perhaps?! ...

Well done Kevin You managed to steer the debate on to the disclosures issue in a situation which must have been pretty nerve wracking ,given that there were a few million listeners hanging on to your every word.
It was also good to hear Iain getting his point accross.

Remember the main aim of your call was to highlight Brendans case and the disclosure issue.
At least they phoned you back after your e-mail and allowed you to put your point across.
Awiting their call at lunch time to see if they use my questions for Mr MacAskill which i will post later if not used.
