Doesn't look as if Kenny MacAskill will be answering questions as we understood.

Here was my questions for him:


Dear Gary
 
In 1982 I was wrongly convicted of Assault & Robbery, I served 4 years in prison and have spent the last 25 years fighting for justice. This has affected my whole life, my health, my relationships and my ability to earn a living.

I believe that victim’s voices should be heard on your programme on Monday and I would like to take part in your programme.

Of particular interest would be an opportunity to put one of the following questions to the Justice Secretary live.
 
1.      Landmark cases like Lockerbie and Shirley McKie and the personal experience of injustice I share with so many others casts a shadow over the Scottish judicial system. DNA and fingerprint evidence is no longer trusted and the realisation is dawning just what an incestuous and self-interested system we have. Would Mr. MacAskill agree and what is he going to do about it.
 
2.      What moves if any are intended to speed up the appeals process? Stuart Gair waited 6 year after the Scottish Criminal Cases Review Commission (SCCRC) referred his case back to the Court of Appeal.
 
3.      What moves if any are planned to make SCCRC independent. (At present 95% of staff are from the Judiciary including Lawyers Judges, Police and Procurator fiscals being the norm)
 
4.      Given that the SCCRC are accountable to no-one will Mr. MacAskill consider instituting an appeals process to deal with complaints about the conduct of the SCCRC.
 
5.      What moves if any will he put in motion to protect sections 6.1 and 6.3 of human right to a fair hearing and make Crown Office accountable for withholding evidence, Something our last government never saw fit to do.
 
6.      I believe that the SCCRC decisions lack consistency. I have been denied an appeal while other cases with the same grounds are referred back to the Appeal Court. Under present rules, even if there are arguable grounds for appeal the  SCCRC can still refuse to refer this. This is a power of discretion that even our courts do not enjoy.
