Letter in Todays Herald By Jim Swire

Perhaps Scots law Might be ignored and this allowed who knows ?

All this time it has been Crown Office and not Westminister that has been blocking this release ?

Another article in the Herald here has quoted Margaret Scott QC as saying:

Margaret Scott, QC, for the defence, told the court that she did not object in principle to a closed hearing nor to the appointment of a special advocate. The hearing continues today.

I am very surprised to say the least that she would concede such, Surely Megrahi is entitled to Legal Representation of his choice to afford "Equality of Arms" This is a fundamental right under Scots Law never mind EcHR' Law.

Just as Edwin Bollier has been saying for a long time.

Everyone in this country knows there is evidence which casts doubt on the timer not only being made for Libya, So what exactly is the problem with releasing this evidence into our courts and public domain ?

The problem now left for our Crown Office to explain is simply:

Was this evidence available to them at the time of the original trial and why was it not made available at the time of trial to the Defence team ?

Apparently we have the fairest system in Europe, well at least according to Lord Fraser.

This is rich coming from Fraser considering he was the one who prosecuted Megrahi, And he was the one who later claimed Gauci wasn't the full shilling.

The following comment though shows, Yes we have an appeal process, Yes Megrahi is into his second appeal, But this does not apply to Scots.

Comment from Scotland On Sunday Article:

Fraser, who originally indicted Megrahi, said: "I think that Scots Law is the fairest and most rigorous system in Europe. There was a trial and an appeal and a second appeal that is one indication of how fair and open a system we have."

We all know I have yet to ever have an appeal, Leave being refused in 1982.
Yet here is Megrahi "A Foreign National" and into his second Scots Appeal (And rightly so) so where is this Most Rigorous System Fraser proclaims ?

Well, Lord Fraser's 'fairest system in Europe' is now hearing attempts by the Crown to limit the appeal by Abdelbasset al Megrahi to only the grounds raised by the SCCRC.

As reported by BBC News :

Looks like a good chance for the Crown to change the law on appeals if it succeeds, and the possibility of such a ruling negatively affecting a great many other cases to the detriment of those who claim miscarriage of justice will no doubt keep the Crown Office and Justice Secretary quite happy.

Reading the latest comments of Dr. Hans Koechler, the thought popped into my mind that no fair appeal will ever be allowed in this case. Too many powerful government agencies in too many countries are aligned against it. In spite of the logic of Dr. Koechler, the emotive pleas of Jim Swire, and the legal arguments of al Megrahi's defense team, the courts will be influenced by all of the claims of security interests to keep evidence from being allowed. Too many governments would be too horribly embarrassed to allow the truth to come out. Better in their eyes to allow an innocent man to spend his life in prison and a government innocent of this crime to pay damages than to anger the guilty governments and challenge their intelligence agencies by holding a comprehensive appeal.

If the following article in the Express is to be believed then you are right.

There will be no embarrassing appeal where all the evidence will be heard, It will be decided on a point of procedure to allow the Crown and our Governments credibility to remain intact.

Lets face it the whole of Scotland thinks he is Innocent.

Identification Flawed In Lockerbie Case

Where have we heard this before ?

Yes from day one I have been claiming because of the conduct at my ID Parade I never got a fair hearing.

My line-up consisted of someone with Blode Hair
Someone with a moustache
Someone with Curly Hair

I had straight Black Short Hair.

The Police showed photos of me before my ID Parade and assisted with the witness all of which should never have been done, See:

Wonder why SCCRC never found this fault when they investigated ?

Was it because the blame for this rests solely with the same person I blame for my wrongful conviction in 1982 and the same person that got Megrahi found guilty, also the very same person who worked with SCCRC while they investigated my grounds, yes their very own William Taylor QC.
Have SCCRC acted in a "Criminal Manner" by not fully investigating this case along with many others ? because of their loyalty to colleagues ?
