Open letter to SNP Cabinet Secretary for JUSTICE, Kenny MacAskill MSP:


Dear Mr MacAskill,

Fatal Accident Inquiries / Crown Office decisions – Immediate reform urgently required

I’m certain you will have seen the Leader in Friday’s Edinburgh Evening News (“Relatives of the dead deserve a [MUCH] fairer system”, 1 June 2007) re the case of Craig Gowans (RIP) and his father’s justified frustration, hurt and anger at being unable to obtain a Fatal Accident Inquiry (FAI) into his son’s premature death at Falkirk Football Club.  

John Gowans has every right to feel aggrieved at having no FAI to examine fully, independently and publicly the events leading up to his son’s untimely passing – as do SEVERAL other bereaved families who are also fighting to be properly heard by Scotland’s high-handed, dismissive, “protector of sacred cows” and largely indifferent Crown Office.  

The Edinburgh Evening News editorial rightly points out the inequity in our greatly-flawed and discredited Scottish “justice” system where, all too frequently, the families of loved ones who have died in mysterious and suspicious circumstances have to fight (and fight, and fight… ), shout, scream, beg and plead time and again (and again, and again… ) to have their cases properly heard and fully scrutinised in front of a Sheriff – in an independent, impartial, open, transparent, fair, just and public hearing.  This inequity has to stop … NOW.

As Scotland’s newly-appointed Cabinet Secretary for JUSTICE you have a great weight and responsibility on your shoulders now, and you carry the hopes of the many thousands of people who have, over the years of Ms Jamieson’s and Mr Wallace’s tenures, been miserably failed by their inaction in bringing about radical change and much-needed reforms to Scotland’s judicial system – lack of FAIs and Crown disclosure, to cite but two.  

It should also be borne in mind that the responsibility you now carry is to the people of Scotland (especially those who have been miserably failed by its judicial system over many years) and not to your establishment friends and many chums at our Crown and Procurator Fiscals’ Offices – no sacred cows should ever be protected, as they have been under the previous Justice Ministers’ and Crown Office very dubious decision-making processes … too many “great and good” protected to instance here (though I will, if you ever want examples).

To show in the very early stages of your tenure that you are taking on board public concern re lack of FAIs and Crown disclosure (to cite, once again, but two areas of Scotland’s unfair and unjust “laws” that are urgently in need of radical reform), I would urge you to put pressure on your friends at the Crown Office to INITIATE IMMEDIATELY Fatal Accident Inquiries into the Craig Gowans case, PLUS these three other appalling and tragic cases that spring to mind:

1. 16-year-old Karen Dewar (RIP) who was brutally murdered in January 2005 next to her home at Tayport in Fife by an untreated / unsupervised (allowed to “slip through the net” … YET AGAIN), feral and very violent repeated sex-offender, 17-year-old Colyn Evans;

2. 17-year-old Danielle Scott (RIP) who was from Glasgow, but died horrifically in February 2005 at the hands of a well known methadone-peddling junkie (Peter Meaney) in his Sighthill flat in Edinburgh, whilst she was allegedly under the proper “care, support, supervision and protection” of Edinburgh City Council’s Social Work Department (within your own constituency at the time of her untimely death of course); and  

3. 30-year-old Swedish girl, Annie Borjesson (RIP), who died in Prestwick in early December 2005 under very mysterious circumstances indeed (her mother, family, close friends and many Scots believe she was “murdered”) - again, she lived within your own constituency in Edinburgh when you were a Lothians list MSP.

If no action is taken on the above as I suggest, then you will indeed be “just another Cathy (Do Nothing / Protector of Sacred Cows) Jamieson” and will, I’m certain, be viewed with a similar loathing and contempt by the people of Scotland – who, may I remind you, have elected you to serve (with impartiality, integrity, probity, fairness and justness) as their new SNP Cabinet Secretary for JUSTICE.

I’m sure you won’t let us all down.

Open letter to SNP Cabinet Secretary for JUSTICE, Kenny MacAskill MSP:

Dear Mr MacAskill,

Annie Borjesson, 1975 - 2005 (RIP) – Fatal Accident Inquiry urgently required

Following our Open Letter to you last Friday, this is another direct appeal to you re the above case which, as a Lothians list MSP for the area in which Annie lived at the time, you will be all too well aware of and, we feel, now have a moral obligation to act upon expeditiously and forcefully (with the new powers and resources at your disposal) for the Borjesson family.

We are certain that you and / or your staff will read this Forum on a daily basis and, therefore, will be up to speed on the many anomalies that surround the very mysterious circumstances which led to Annie’s premature death at Prestwick beach, on or around Sunday the 4th of December 2005. There are also many further anomalies subsequent to her body being discovered at or around 8.30am that Sunday morning. All these anomalies MUST be PROPERLY, INDEPENDENTLY and IMPARTIALLY INVESTIGATED by a Fatal Accident Inquiry as soon as possible.

Annie’s distraught mother (Guje) and family, close friends and we, the Concerned People of Scotland, all feel there are sufficient grounds for this case to be re-opened by the Crown Office and for a Fatal Accident Inquiry to convene to examine the many anomalies surrounding the very mysterious circumstances leading up to and after Annie’s untimely passing.

As our new Cabinet Secretary for JUSTICE, and a father of two yourself, we hope you will take on board our many concerns over the suspicious circumstances surrounding Annie’s passing, and its subsequent “investigation” by the local constabulary and PF’s Office in Kilmarnock, and now DEMAND that this very mysterious and tragic case be re-opened … IMMEDIATELY.

We trust you won’t let the people of Sweden and Scotland down.

It has just been announced on todays news that a FAI will take place regarding Danielle Scott, Great news and one we have called for for a long time, Maybe better things will come with SNP.

Dear AL and Big Wullie !

I am so very pleased to hear that a FAI will take place regarding Danielle Scott. And I really Hope that You are right aboute BETTER THINGS WILL COME.

Annies family, who is having a very difficult time. Especially now because of the delayed funeral of their beloved daughter, also needs a FAI to get closure and to get the truth about what happened to Annie.

At this very moment the family needs all our sympaties and understanding during this comming weeks, when their daughter and our dear friend Annie will be put in ground to her final rest

Please think of them in Your Prayers!

I noticed an item in yesterday's Scotsman on questions put to Kenny MacAskill by members of the legal profession & judiciary.

The questions, such as they were phrased, and the Ministers answers are a good indication perhaps of what we may expect and have to battle ...

Since it is I suppose my own opinion, I will leave it for readers to visit the link & read it there rather than repost it to this forum.

We will have to be as vocal as possible I think, to overcome the likes of judicial & legal profession resistance to the changes & reforms we are seeking ...

With regard to your very interesting and informative commentary (as usual) re MacAskill from Monday’s Scotsman, the decision surely for our new Cabinet Secretary “for Justice” is really quite simple:

Scotland’s People – Population c.5,000,000.

Scotland’s Lawyers – Population c.10,000.

There are 4,990,000 reasons why MacAskill has to now put aside any loyalties he may still harbour for his former legal “profession”, and henceforth put his Edinburgh constituents and the People of Scotland FIRST – that’s the 4,990,000 non-lawyers.

If he wants to remain a mouthpiece for Scotland’s legal profession, then he must resign immediately and return to being one of the gang of 10,000.

No “conflicts of interest” JUSTICE Secretaries are welcome, or should be allowed to continue, by the People of Scotland – we’ve had enough of that over the past 8 years.

Conflicts of interest = Protection of sacred cows = Conspiring to defeat the ends of justice. Ever thus.

So, Mr MacAskill. What is it to be?

Answers on a postcard please to……

Better still. How about responding on this forum??????

WELL SAID AL, LAWYERS ARE ALL PART OF THE SYSTEM AND A LOT HAVE BEEN PAID BY THE CROWN FOR NOT DOING THERE JOB RIGHT.

THATS WHY SOME LAWYERS SEEM TO GET REGULAR CLIENTS OFF ON A REGULAR BASIS. IF THEY SEND ONE BIG FISH DOWN THE RIVER THE SAVE 50 60 MORE .

SCOTTISH JUSTICE IS A LAW IN ITS OWN RIGHT BUT IT NEEDS FINE TUNING.

THE APPEAL COURTS CLOGGED TO BURSTING POINT BY ANY TOM DICK AND HARRY SAYING THEY NEVER GOT A FAIR TRIAL.

WHILE THE REAL INNOCENT MEN AND WOMAN HAVE TO FIGHT TOOTH AND NAIL TO TRY AND GET JUSTICE .

OUR JUDICIAL SHOULD OPEN UP A BIT MORE AND REALISE THAT THERE IS A DRACONIAN SECTOR WITHIN.

IT IS TIME TO STOP INJUSTICE IN SCOTLAND FOR ALL THE INNOCENT MEN ,WOMAN AND LET THE CROWN BE MORE ACCESSIBLE TO THE PUBLIC,

FOR ALL MANNERS OF INJUSTICE.

How right you are my friend.

All the regular posters on this forum know that, as do THOUSANDS of other Scots whose lives have been greatly damaged, almost ruined and, very often, completely destroyed by our self-protecting / serving and wholly unaccountable 10,000 lawyers over the years.

Just go over to Peter’s excellent blog for a few examples of this (I’m sure you have FK2). He’s a man who can, and does, enlighten us all very, very well and deserves the highest praise from the people of Scotland for exposing “crooked” lawyers and their “corrupt” self-regulating practices … which have been allowed to continue for DECADES.

With regard to your own praiseworthy and dogged fight for Brendan and Patrick:

Why don’t you post an “Open letter” here too (copying it to the new JUSTICE Secretary) and see if MacAskill responds. Frankly, from what I’ve read of your posts (and well done you for campaigning for your friends as you have), the case is one BIG FIT UP, and those at U Division and the local PF’s Office who appear to have done this to your friends should be properly / thoroughly investigated and banged to rights if criminality has occurred. Get Wullie to help you (if necessary) should you decide to write to MacAskill. And, if you do, be sure to post his reply on the forum. It will be very interesting to see what his response to your allegations about U Division and the local PF’s Office will be.

AL, THANKS I HAVE LOOKED AT PETERS WEB SITE, AND SEEN BRENDANS TRIAL LAWYER ON IT LOL.

I CANT MENTION HIS NAME AL.

THE MORE PEOPLE LISTEN THE MORE WE CAN HIGHLIGHT ALL TYPES OF MISCARRAIGES IN SCOTLAND.

THERE IS MUCH INJUSTICE IN SCOTLAND FROM FIT UPS TO MURDERS PASSED AS ACCIDENTAL

I WILL POST LETTERS TO THE MAFIA BUT I DONT LOOK FOR RESPONSE.



THE PF AND U DIVISION LIKE THE LEAFLETS ONLY TIME WILL TELL WILL THEY TURN ON THERE OWN ?.

I completely agree Al with your comments, and thanks for the compliment on my website.

While we are doing open letters to Kenny MacAskill, and the Judiciary are doing open letters (phrased more as veiled threats) to Mr MacAskill, how about our new administration does an open letter to the victims of injustice in Scotland.

I'm sure such a move would be very appreciated by the many people out there who have not had the chance to air their cases in public or in the media as some of us have been able to.

I had the good fortune to catch the Scotsman's ear in the 1990's with my own case, which brought about many articles, and supporting editorials from the newspaper calling for justice and an end to self regulation of the legal profession (oh sadly, how times have now changed at the Scotsman due to influence from the legal profession and a reluctance to take it on as they once did) ...

.. but not everyone of course has been fortunate enough to get their story in the newspapers or on tv - so it's time to bring the right of all those unheard voices out there into the fold and give them a chance to put their point across.

What our new Executive should now do is say to the country something like - "We are aware of what has been going on for so long, we acknowledge it's time to listen to you, so tell us of your injustice & suffering" .. and in that, I mean direct to the First Minister & Justice Minister themselves - right to the top - not through some Parliamentary Committee which censors out what gets into the public domain.

We have change in our Government - it's time for a change in attitude and time to listen to us instead of those who seek to maintain their ivory castles built on the ruined lives of the public they have 'served'
