From the very outset we have suspected that the failure to conduct a proper murder inquiry as instructed by the PF was not incompetence, but a deliberate attempt by individual police officers connected to the case to both mislead the family and pervert the course of justice.

Will the Area PF bring criminal charges ??

Lets not forget that the Area PF and Chief Constable both literally share the same bed, and are good buddies.

Thats what were up against in this small close knit community, where no one wants to rock the boat.

Dear Sir / Madam

FREEDOM OF INFORMATION REQUEST - UNSOLVED DEATH OF KEVIN MCLEOD

I refer to the Freedom of information (Scotland) Act 2002.

I would be grateful for the Crown and Procurator Fiscals Service in Inverness to disclose in the interests of truth and justice, information regarding our son Kevins unsolved death at Wick harbour in February 1997, of which we Kevins grieving parents request for our own interest, and in the interest of the general public that resides within the Highlands and Islands Area.

It is our quest to ensure that the person(s) that was involved in our sons horrific death are brought to justice, and to also expose those who we suspect of concealing the truth and perverting the course of justice.

The information which we Kevins parents request be disclosed by the Highlands & Islands Crown and Procurator Fiscals Service is as follows, -

1 - The names ot the person(s) that murdered our son Kevin at or around Wick harbour on Saturday 8 February 1997.

2 - The names of the police officer(s) that was involved directly / indirectly with our son Kevins death at or around Wick harbour on 8 February 1997.

3 - The name of the prisoner that was released on temporary weekend home leave from Porterfield Prison on Friday 7th February 1997 who we suspect was involved with our sons death.

4 - The names of all those in authority who had a connection with the case, who have from the outset, colluded and concealed crucial information regarding the true circumstances of our son Kevins unsolved death at Wick harbour on 8 February 1997.

5 - The names of all those in authority who 5 years after Kevins death, concocted and fabricated a theory that the massive internal injuries that Kevin sustained, was by falling on to Lobster Creels on board the fishing vessel Aurora.

6 - Disclose, whether the person(s) involved with our sons death, and those in authority, who are protecting those responsible, are members of Masonic lodges.

7 - Disclose, why Police Officers failed to conduct a proper Murder inquiry as instructed by the Procurator Fiscal on Monday 10 February 1997, after the Patholigist informed him that, Kevins injuries was consistent with a kicking received several hours prior to entering the waters of Wick harbour, which in any event would have been fatal.

8 - Disclose, why Junior Police Officers based in Wick, failed to request the involvment of Senior Police Officers after Kevins death was upgraded to a Murder investigation.

9 - Disclose, why the Procurator Fiscal at the time of our sons death failed to ensure that a proper Murder inquiry was undertaken by police as per his instructions.

10 - Disclose, as to why the two Patholigists who conducted the post -mortem examination was not at any stage informed by Police that Kevin had been physically assaulted prior to his death.

12 - Disclose, why Police Officers did not inform the Procurator Fiscal that Kevin had been assaulted by a named male person prior to his death.

13 - Disclose, why a Police Officer(s) at the first opportunity destroyed Kevins clothing after Kevins death had been upgraded to a Murder investigation.

14 - Disclose, why Police failed to seize, retain and submit for forensic examination the clothing worn by our son at the time of his death, particulary, when the investigation was upgraded to a Murder Investigation.

15 - Disclose, why despite interviews being undertaken by Central Scotland Police with all Northern Constabulary Police Officers who had a connection with the property of our son, did Northern Constabulary Police Officers fail to inform the enquiry team of where, when and by whom destroyed Kevins clothing.

16 - Disclose, why Police failed to cordon off the crime scene and conduct a forensic examination after the Procurator Fiscal had instructed a Murder investigation to be undertaken.

17 - Disclose, why Police failed to conduct door to door enquiries after the Procurator Fiscal had instructed a Murder investigation to be undertaken.

18 - Disclose, why Police Officers misled my family by informing us that all taxi drivers and propeitors had been questioned.

19 - Disclose, why Police Officers failed to trace and interview a named individual, despite this person three months later surrendering, and admitting to having assaulted Kevin prior to his death.

20 - Disclose, why Police Officers had taken three months to trace and interview the local owner of the fishing vessel Gunhilda.

21 - Disclose why Police had taken seven months to trace and interview the local skipper and crew of the fishing vessel Gunhilda.

22 - Disclose why Police failed completely to trace and interview the local owner and crew of the fishing vessel Aurora.

23 - Disclose, why Police failed to trace and interview the taxi driver that picked up two potential suspects from the Waterfront nightclub, after the Procurator Fiscal had instructed a Murder inquiry to be undertaken.

24 - Disclose, why Police failed to trace and interview the taxi driver that picked up one of two potential suspects from a telephone kiosk in Union St, after the Procurator Fiscal had instructed a Murder inquiry to be undertaken. 

25 - Disclose, why Police failed to check all local taxi firms logbooks.

26 - Disclose why police failed to appeal, trace and interview a group of people who was seen near Kevin in Martha Terrace by the harbour, after the Procurator Fiscal had instructed a Murder inquiry to be undertaken.

27 - Disclose, why numerous witnesses with significant information was bizarrely excluded from giving evidence under oath at the Fatal Accident Inquiry held in 1998.

28 - Disclose, why three Senior Police Officers who had a connection with our sons case, suddenly retired shortly after Central Scotlands Chief Constable submitted his enquiry report to Northern Joint Police Board.

29 - Disclose, as to why when I address my letters concerning the 2002 Creel theory to the Procurator Fiscal who was personally and directly involved, does the Area Procurator Fiscal, who had no direct involvment, respond on his behalf, or requests for some other close colleague to respond.

30 - In 2002 ( 5 years after Kevins death) it was suggested, and agreed by Police and Crown Office officials,that a report be submitted to a Home Office Patholigist from London for his expert opinion, informing him of the ludicirious theory that the area of brusing and abrasion of the (diamond shaped mark) on Kevins body was consistent with Kevin falling on to a Lobster Creel(s) on board the local fishing vessel 'Aurora' berethed in Wick harbour. Therefore, can you please disclose, why this crucial witness, owner / skipper of the Aurora, was not at any stage interviewed by the Police or Crown officials regarding his fishing vessel, particulary, when the owner later informed my family and a retired detective who was assisting my family, that he did not have any lobster creels on his vessel as he had only accquired the vessel.

31 - Disclose, why the Procurator Fiscal connected to the Creel Theory instructed Police Officers not to interview crucial witness, the Owner & Skipper of the local fishing vessel Aurora. 

32 - Disclose, why neither the Procurator Fiscal or Police Officers connected with the Creel theory informed a Home Office patholigist, that the local owner / skipper of the fishing vessel Aurora was neither traced or interviewed.

33 - Disclose, why the Procurator Fiscal connected to the Creel Theory and Police Officers misled a Home Office Patholigist by informing him that there was lobster creels on board the deck of the local fishing vessel Aurora at the time of Kevins death, when, in fact, the owner and skipper later stated, that there had been no lobster creels on the deck of his vessel at the time of Kevins death.

34 - Disclose, why with Kevins death occuring on Saturday 8 February 1997, did the Procurator Fiscal connected to the Creel Theory, bizarrely agree with Northern Constabulary Police Officers to submit for the expert opinion of a Home Office Pathoiligist, 4 colour photocopies of the scene bizarrely dated 24 September 2001, 5 black and white photographs of the bollard at Wick harbour bizarrely dated 31st August 2001, copy of a sketch (not photograph) of the motor fishing vessel ' Gunhilda ' bizarrely dated 28 December 1997, also, original sketches (not photographs) of the motor fishing vessel 'Aurora ' at the scene at Wick harbour bizarrely dated 19 September 2001.

35 - Disclose, why during the ' initial murder enquiry' or indeed ' 5 years later' was this Lobster Creel theory / suggestion, which was provided to a Home Office Patholigist for his expert opinion, not provided by the Crown or Police to the two Patholigists at Raigmore Hospital, Inverness, for their expert opinions, of who with Kevins death being treated as suspicious was indeed the actual Patholigists that conducted the post mortem examination.

36 - Disclose, the reason why, when ever my family or I correspond to Crown Office officials with concerns regarding my sons unsolved death, that they disrespectfully and bizarrely forward my concerns to a Freedom of Information colleague for their response.

37 - Disclose, why a High Ranking Senior Police Officer who had a direct connection to our son Kevins case, mislead Her Majesty's Chief Inspector of Constabulary for Scotland, a Principal Procurator Fiscal Depute, and an MSP.

38 - Disclose, whether it is procedure for the Detective leading the initial Murder investigation to be seen laughing and in lengthy conversation with a potential suspect during a lunch break at the Fatal Accident Inquiry.

39 - Disclose, why Police Officers alledgedly threatened an individual who informed my family of alledged Police involvment with our sons death, to stay away from my family.

40 - Disclose, why every single witness that has came forward from the outset with information regarding our son Kevins unsolved death has bizarrely been branded by Highland Police and Crown Officials as either, a Liar, or a drunk, or that they cant recall, was colluding, not credible, no substance, or retracted their statement.  

41 - In correspondence of 13 November 2008 from the Fiscals Service in Inverness, and in response to my letter of complaint dated 7 November 2008, of which I lodged a complaint stating, that the Procurator Fiscal in Wick, at the time of Kevins death, failed to ensure that a proper and thorough Murder enquiry had been undertaken by police, the response from the Area Procurator Fiscal stated that, he can find 'no fault' in the way that his colleague the Procurator Fiscal in Wick had dealt with the Murder investigation.  However, Central Scotlands Chief Constable Mr Andrew Cameron in his independent conclusion in 2002 stated," It has to be acknowledged that the enquiry that followed the post mortem findings lacked objectivity, clear accountability and ownership, and crucially, supervision and direction above the rank of Detective Sergeant, in order to appropiately challenge assumptions and resolve inconsistencies which were apparent and significant". Sheriff Ian Cameron in his Fatal Accident Inquiry ' Open Verdict ' determination published in 1998, also critisied the dereliction of duties by police during the initial Murder enquiry, in particular, the lack of Senior Officers which he stated, " was somewhat curious". Scotlands Police Complaints Commissioner Mr Jim Martin in his independent report published in 2007 stated," There is no doubt that some elements of the initial investigation into his death were handled very poorly. This has been acknowledged by Northern Constabulary". Therefore, can you please disclose, whether or not the Fiscals Service in Inverness still finds no fault regarding the Procurator Fiscals actions, in that, the Procurator Fiscal failed in his duties to ensure that a proper and thorough Murder enquiry was conducted by police, despite three independent reports from hghly regarded individuals in high office,all indeed criticising the Inital Murder inquiry that was undertaken by police.

42 - Disclose, why did the Procurator Fiscal who was in charge of the Murder inquiry or one of his deputes failed in their duties to attend the dissection, which being a suspected homicide should by law attend, to ensure that any medical problem or apparent contradiction in the pathological findings is further investigated to a soloution and that all known non-medical facts are properly investigated and explained by the Patholigists. He or one of his deputes should have attended to ensure that the patholigists fully explore the findings to determine whether the non-medical facts can be reconciled with medical conclusions. 

43 - Disclose, why as stated in Central Scotland Chief Constables report, was the Procurator Fiscal at the time of Kevins death, unavailable for interview by the Chief Constables enquiry team, during their ten months enquiry, as his unavailability for interview prevented a definitive version of events from his perspective and of which has not been established.

44 - Disclose - what was the view of the Procurator Fiscal at the time of Kevins death. Was it his position that police had conducted a proper and thorough Murder Investigation as instructed by him.

Your acknowledgement and co-operation regarding my information request would be welcomed and appreciated by we Kevins parents.

When a complaint is made against police officers surely it is procedure for another force, an independent police force, to make enquiries.

I should also like to add my good wishes and hope that you and your family find at least some answers.

Lydia, Yes I agree, but then again, can another police force be classed as " Independent". We have asked the Chief Constable on numerous occassions over the years to have another force investigate his forces investigation(s) regarding Kevins unsolved death, and will he do it. -
No Way. Why ?

We have from the very outset suspected that a police officer(s) and or a prisoner on weekend release was involved with Kevins death.

We also found it suspicious that the Scottish Prison Service informed us in 2007 that they did not hold information regarding this prisoners movements, (aye right), however Kevin Dunion the FOI commissioner  in his 2007 decision concluded ------ "Having examined this information and the wording of Mr McLeod's request, I am satisfied that the information does in fact fall within the scope of the request. I must therefore disagree with the Ministers' assertion that the recorded information was insufficiently accurate to enable the SPS to identify whether the information was held. I consider that the SPS placed too narrow an interpretation on the wording of the request and, as a result, I consider the SPS was wrong to inform Mr McLeod that the information was no longer recorded".

Also Central Scotland Police during their enquiry regarding our complaints in 2002 and the Crown office have informed us that it is not in their remit to investigate the movements of this prisoner. - Why ? - Cover -up or what ?

I simply do not agree with the police force or any organisation investigating complaints against the police force or relevant organisation .

BUT I also believe their are good and bad in every organisation.  Until it is decided that a completely independent organisation and a fair one will in the future carry out these investigations a chance may exist that a police officer with integrity may find out more than you have.  Obviously I am wrong but i believed that it was compulsory when a complaint is made against a police officer or a force than another force investigate the complaint.  

It may be worth checking the complaints procedure for info on that issue.

I refer to Chief Constable Latimers letter dated 23rd March 2009, of which he informed me that, he had passed my correspondence and enclosures on for your attention, and that you will respond to me directly in due course.

I would therefore be grateful for you to inform me at your first opportunity, of what action, if any, you intend, regarding the information provided in my letter of 18 March 2009 addressed to the Chief Constable.

I sincerely hope that you will not take the same approach as your predecessor, who's attempt on numerous occassions to mis-inform and mislead my family and I failed dramatically.

Therefore, please be assured that your credibility and integrity along with any officers that you may instruct to investigate my recent, or indeed any information regarding my son Kevins unsolved death, will be rigorously monitored and scrutinised to ensure that you comply with police procedures in a proper, truthful and satisfactory manner.

Your professional respect and acknowledgement to my correspondence would be appreciated.
