Obviously they won't even be shamed into a fresh or an independent look at the evidence

FOI DECISION - Prisoners movements - Still no Joy

PREVIOUS FOI DECISION  2007--
"Having examined this information and the wording of Mr McLeod's request, I am satisfied that the information does in fact fall within the scope of the request. I must therefore disagree with the Ministers' assertion that the recorded information was insufficiently accurate to enable the SPS to identify whether the information was held. I consider that the SPS placed too narrow an interpretation on the wording of the request and, as a result, I consider the SPS was wrong to inform Mr McLeod that the information was no longer recorded".

Deputy Crown Agent Brisbane 5 Nov 07 ---
Whether Mr xxxxxx or anyone else was held at Castle Huntly Prison at any other time is information not held routinely by Crown Office or the Procurator Fiscal and there is presently no proper basis at present for us to seek to obtain it.

Central Scotland Police Report 2002 --- It does not lie within the remit of this enquiry to investigate the issue of xxxxxx xxxxxxxx imprisonment.

I do not understand why on earth they cannot give you any of this information.  I am so sorry that these people are dragging their feet and prolonging the agony for the family.

If you have an allegation that this prisoner guy may have been involved in Kevin's death, then I do not see why they cannot investigate this fully.

I am sure it must be easy for them to access this guys information and do the checks needed.

Then if you are correct that he was on leave or whatever that night, then he should be interviewed.
Seems pretty simple to me but the Crown and those in "power" seem to complicate everything with their needless secrecy.

Area Fiscal takes no action against police officers.

This outcome by the Area PF comes as no surprise as he and the Chief Constable are P- - - - - - in the same pot  It therfore appears that during a Murder Inquiry here in the Highlands it is acceptable for police officers to immediately destroy vital evidence, not to inform patholigists of crucial information and not to trace and interview crucial witnesses.

We are not only fighting a corrupt and inept police force to get justice for Kevin but it also appears that we up against a Fiscals Service whos role is referred to as 'Independent' must also be questioned. We believe that we will never get justice until another Police force is instructed to re-investigate both Kevins death all the evidence to date, and the report submitted to the Lord Advocate or Solicitor General and not the Local Fiscals office.

If the Chief Constable has nothing to hide or fear and to put and end to the matter, why does he refuse our one and only request. However, he is prepared to spend thousands of tax payers money at the Court of Session appeal later this year in an attempt to over turn the FOI Commissioners Kevin Dunions decision to release the names of police officers based at Wick police station at the time of Kevins death.

We wont hold our breaths for any surprise outcome from the Deputy Chief Constables as we suspect it will no doubt be yet another whitewash where police officers involved will again appear smelling of roses and whiter than white.

We Kevins family believed that the information recently provided to police on 18 March 2009 was the biggest break-through since Kevins death. The information included witnesses names, and identifies those alledgedly involved (of who we had always suspected), and their profession, of which would have proved that Kevin was indeed murdered. We was awaiting the police to contact us to say they would be investigating this new information. Instead, we were amazed to receive a letter informing us that the case was now closed and that the information provided in our dossier was being treated as a complaint. - A Complaint !!!!!

This has to be the biggest cover-up by a Scottish Police Force in recent times. (and possibly the Fiscal service).

(Q) - Why do they not want to investigate this crucial information and possibly solve this case ?

(A) - In fear of embarassment and shame, and of the truth being exposed as to the true circumstances surrounding Kevins death, but more importantly, who it was that was responsible for Kevins murder. They would then have to scurry out the exits of Police Head Quarters like the bilge rats that they no doubt are.

Cover-Up, Cover-Up, - Cover- Up.

This should be fully investigated, especially since it was stated in court. It has not be ruled out so how on earth can they now "know" it was an accident?

Thanks for that.

As everyone thats logs on to this site is well aware that this is what we have had to endure from Northern Constabulary since Kevins death.

We Kevins family, the media, the general public, all suspect who was involved with Kevins murder, but more importantly Northern Constabulary knows who was involved with Kevins murder, and that why they have to continue with the Cover-up. - To protect those responsible and to protect the integrity and reputation of Northern Constabulary Police Force.

Respect the police - No chance. They are all corrupt and rotten to the core. Every single one of them from every single police force In Scotland.

Very much connected to this topic, we have started a petition calling for the resignation of Jack Straw, Alex Salmond and Kenny MacAskill due to breaches in the ministerial code in connection with the Justice system.

Latest Press Article below. We are determined in our fight to expose the truth regarding this prisoners movements. Why wont the authorities tell us ? I think we all no why. When it is eventually dislosed, be well assured many many heads will roll. Cops state there has been no new evidence. Oh yes there has, - allegations of police involvment. However, instead of investigating this significant information they referred it to the Area PF as complaints. We wonder why!!  This was crucial ' information ' from named individuals not complaints.

Dismay over MacAskill standpoint

Scottish Justice Minister Kenny MacAskill has failed to cast light on the movements of a former prisoner who has been connected with the death of a young Wick man. The family of Kevin McLeod believe the prisoner was at liberty on the weekend the 24-year-old was found dead in the town’s harbour in February 1997. They have so far been stonewalled in their efforts to find out whether the individual who was allegedly seen fighting with Kevin on the night he went missing was on home leave at the time. In a response on Tuesday to a written question tabled by far north MSP Jamie Stone,Mr MacAskill yesterday continued the official block. The Minister adopted the stance of the Scottish Prison Service whose chief executive Mike Ewart said that disclosing the information sought would  breach the Data Protection Act 1998. Mr Stone said he is dismayed by the response and would be following it up with a letter to Mr MacAskill, seeking a meeting over the family’s request. Mr Stone said the disclosure of the information is in the interests of justice. He said: “I see no reason why the question of whether the prisoner was or was not on home release at the relevant time should not be answered fairly and squarely. “It seems to me that if the man in question was, indeed, in custody, it would have been easy for the prison service and the Minister to have said so.” The McLeod family believe the individual who was then 27, was involved with others in a savage attack on Kevin shortly before he died. They have information that the individual was released on weekend home leave from Porterfield Prison, Inverness to Alness on February 7-9, 1997. They believe he travelled by bus to Alness on the Friday to Wick. The McLeods contacted Mr Stone after failed attempts to find out from the S.P.S. and Northern Constabulary whether or not the prisoner was out at time. The family earlier this year had a Freedom of Information request rejected. Kevin’s uncle Allan McLeod was disappointed by the further knockback yesterday.  He said: “It’s annoying but I take the continued refusal to release details of the prisoner’s movements as a strong indication that he was at liberty on the weekend of Kevin’s death. “We won’t let this go and we’re determined to resolve this one way or the other. “Everything points to this individual being out at the time and we have witnesses that saw him in an altercation with Kevin. The family has been pressing that the ex-prisoner believed to be living in the Far East , along with two others they suspect of assaulting Kevin, be the subject of a cold case review carried out by a force other than Northern Constabulary. Northern Constabulary say there has not been any new evidence to prompt a fresh investigation.
