Dear Mr. Salmond.

JUDICIAL ENQUIRY INTO THE JUSTICE SYSTEM

As an Innocent man convicted wrongly of Assault & Robbery in 1982and still fighting
to even have an appeal in our Courts, I note that you are committed to a Judicial Enquiry in the case of Shirley McKie.

While this is a welcome step it will not necessarily help other miscarriages of justice in Scotland including mine. I feel that I have not been listened to for the past 25 years and hope that your decision indicates that injustice is Scotland is going to be properly examined.

I feel let down by the SCCRC, the Crown Office the Ombudsmen, FOI Commissioner and even the Standards Commissioner. I feel they all prefer to cover up for each other. One of the problems is the incestuous nature of our Justice System where there is little truly independent arbitration and I and others fighting for Justice are effectively asking Police and Lawyers to find fault with their own.

As we hopefully enter a new era of Government in Scotland I would support
the call for an Independent Enquiry into our Justice System in the hope that
Lessons will be learned from past mistakes and a fair and equitable system
for dealing with Injustice will be found.

Given your commitment to the McKie enquiry I would ask that you broaden it out to examine the whole Judicial System with a view to establishing a fairer justice system in Scotland.

I feel any enquiry should examine among other things:

1.SCCRC which should have an Independent complaints body set up to enable applicants not happy with their services to complain to. At the moment the person you complain of deals with such complaints. In my own case I felt that they were not acting Independently or Impartially as they proclaim.

2.Crown Office Disclosure Policy. There have been recent complaints in this respect from the legal profession. The Crown has withheld exculpatory evidence with Kidd and Gair being the most recent in Scotland to win appeals on this ground. The Crown are still practising this policy and still withholding Crown Statements. This must end and they need to be made accountable for doing so.

3.Appeal Courts. Our dilapidated laws badly need updated. The whole structure of fairness at appeals needs looking at.

4.Legal Aid. I was refused legal aid unjustly. Equality of arms must apply to everyone and everyone has the right to be legally represented in any court. If
this is refused it must be seen to be unfair and against Section 6 of Human
right to a fair hearing.
5.Other Issues.

The structure, operation and powers of the Law Society.
The structure, operation and powers of the SLS Ombudsman.
The Independence and accountability of the legal profession.
The independence and accountability of the Lord Advocate.

I am writing to you in the hope that a new government committed to an independent Scotland see the need to carry out a comprehensive review of our justice system. Let’s ensure that it is fit for purpose and that the many people like myself fighting for justice can have renewed hope that at least they will be listened to and that they and their families will not be condemned to a life of increasing bitterness and frustration.

In support of our cry for a broader Enquiry my wife has posted the following with my letter.

Having been witness to the effects of being wrongly accused of something and wrongly imprisoned
I write to you as the wife of William Beck to support his call for you to Broaden your Enquiry Remit to engulf the whole Judicial System and not just the case of Shirley McKie.
We must establish a fairer Justice System in Scotland, One we can say is Independent.
For this we need to rid the Judiciary of Self Regulation Completely.
How can we still be asking Lawyers to investigate Lawyers Police, SCCRC, and Lord Advocate who of course is answerable to No-One. This practice must cease.

big wullie is right to keep the fight, we need change in the legal system. the legal firms are to be held responsible, brendans trial lawyer in court on charge himself. see scotcourts and this is the way the legal world works . free the killie2. and give william beck a fair and decent appeal.

Good letters William, and I hope Mr Salmond looks closely at these issues with a view to rectifying the injustice of the past which the previous Executives have allowed to go unchecked.

My daughter, Annie Borjesson (7 February 1975 – 4 December 2005)

There are no words in the Swedish, Scots or English language that can begin to express the pain, torment and distress that a parent has when having to lay to rest one’s child in the prime of their life. In the normal order of things, that should just never happen. But next week in Lagmansholm, Sweden, I will be that tormented parent grieving at my daughter’s graveside, still asking “Why?” and “How?” this has happened … still searching for the proper answers and the truth behind my daughter’s very mysterious death.

Annie (Borjesson), my 30-year-old daughter, lived and worked in Edinburgh, Scotland, until her premature death, when her body was discovered on Prestwick beach in Ayrshire around 8.30am on the morning of Sunday 4 December 2005. I am only being permitted to bury Annie now, some 19 months on, as the last medical tests have finally been performed and her body has been released to my family by the Swedish authorities. This delay, in itself, has caused great distress and heartache to my family and Annie’s friends.

The “verdict” on Annie’s death by the local constabulary and Procurator Fiscal’s Office in Kilmarnock was either “suicide” or “tragic accident” – neither of which we (Annie’s family, close Swedish friends and many Scottish friends) can believe or accept. We believe that Annie was in fear for her life when she rang home from Edinburgh during the week leading up to her death. She even went to the length of calling us from pay phones for fear of being overheard at the Linton Court Apartments in Murieston Road (Dalry / Gorgie area), West Central Edinburgh, which she shared with many others – many others who cannot now be traced, who fled the country in “fear” to India (in one case) and who were not properly questioned or sought by the Scottish police in the course of their “investigations” into Annie’s death. In short, we believe that Annie was murdered (a murder that was made to look like “suicide” or a “tragic accident”) in or around Prestwick on the night of Saturday 3 December 2005, and that her killer or killers are still at large.

My family’s vain efforts (in trips to Scotland, via letters and in telephone calls over these past 19 months of “hell” and anguish) to get the Scottish police and Crown Office to take our concerns and many unanswered questions on board have been met with the most appalling (perhaps typical) bureaucratic indifference and stonewalling at every single attempt in trying to get them to take us seriously, and to properly investigate the many anomalies and unanswered questions surrounding Annie’s very suspicious death. “Case closed … End of Story” is how it presently stands, with your “caring” and “highly-efficient” Scottish “justice” system. Well, Mr Salmond, it is not “Case closed … End of Story” as far as this mother and family are concerned – not by a country mile.

My first port of call now, in my quest for the truth (“the whole truth and nothing but the truth”) and “Justice for Annie”, must therefore be to your door as Scotland’s new First Minister and the most powerful and influential man in your “beautiful land” – Annie loved Edinburgh, Scotland and your kinfolk and spoke with a passion of your “beautiful country”, so PLEASE don’t let that passion and spirit down and help us to get to the truth and “Justice for Annie”.

We, the Borjesson family and Annie’s close friends, do hereby formally request that you take our concerns, unanswered questions and serious allegations on board and have Annie’s case re-opened and properly investigated by the Scottish police and Crown Office, and that a Fatal Accident Inquiry be immediately convened to have the very suspicious circumstances prior to and subsequent to Annie’s premature death thoroughly, impartially and independently examined in front of a Scottish Sheriff.

We hope and pray, as we lay our beloved Annie to rest next Tuesday (26 June 2007), that you won’t let our family and Annie’s close friends down, and you will help us get to the truth and …… “Justice for Annie”.

With the impending funeral of Annie Borjesson next Tuesday 26 June, i am re-posting this letter (inserting the relevant links) to Mr Salmond, Scotland's First Minister, in the hope that he will now do the right, proper and decent thing, and get this case re-opened and thoroughly investigated by the Scottish authorities once and for all - anything less brings SHAME upon him and the People of Scotland.  

We trust he will now do the decent thing for this devastated family.

While the following is not an Open Letter, it is a clear statement to the two men concerned:

A clear message to Messrs Alex Salmond and Kenny MacAskill from Peter Cherbi below … but are they listening and will they ever act to rid Scotland of all the injustice that is being constantly highlighted on this Forum???

Obviously they are otherwise occupied with ongoing events following yesterday’s terrorist attack at Glasgow Airport (along with their “good friend”, the Lord Advocate, Elish Angiolini … hmmm!), but they must be seen to act on ALL the issues and individual cases raised time and again here, ever since they were elected to serve The People of Scotland (NOT their elite establishment lawyer chums) two months ago.

Can I suggest they start by re-opening the Annie Borgesson case as repeatedly requested and highlighted on this Forum.


"Wisdom, Justice, Compassion, Integrity" – the words inscribed on the Mace at the Scottish Parliament.

Note especially the words JUSTICE and INTEGRITY … Messrs Salmond and MacAskill.

Thanks for your comments everyone and now that the SCCRC have made the conclusions of their Lockerbie Trial report public, those of us who fight injustice in Scotland have something more to add to our arsenal, in a sense.

The test of clearing injustice of course, falls to Kenny MacAskill, Alex Salmond, and others in the SNP who know full well of the suffering of their constituents, & others. That suffering cannot & should not be ignored - time to act, and if you do, you will do Scotland a favour.

For those of you who wish to send me your complaints reports from the Law Society of Scotland & the Scottish Legal Services Ombudsman, go ahead. I'm sure the public will benefit from seeing these reports published on the internet in their entirety .. and it may bring an increased understanding of the injustice people go through when taking issue with the legal profession itself.

Dear Mr Salmond and McKaskill!
Dear freethekillie2, Ian Al, Big Wullie and peterCherbie!


Well said Ian, We can only agree with the words You wrote;
"The fight for JUSTICE will continue. Her memory demands no less"

Annies family asked me to tell You All that they can feel the love and caring from the concerned people of Scotland all the way to Sweden through the thousand winds that blow.
And especially when they read what You have written on the shirleymckie forum.

Thank you all for lighting candles, taking a moment out of our day, to respect the memory of Annie and We could indeed feel Your thoughts and prayers fly across the North Sea as a warm embrace.

We hope that, “Justice for Annie” and her family will finally be done …… and be SEEN to be done.

Now We hope and pray that Mr Alex Salmond MP / MSP, First Minister of Scotland and Mr Kenny MacAskill MSP, Scottish Cabinet Secretary "for JUSTICE" will HELP the family and all of Us friends and People of Scotland to get the death of Annie Börjesson reopened.

Please Mr MacAskill and Mr Salmond, please do the right thing, there is nothing that can compensate the family, there is no retroactive help that is coming to the devastated family!!!! BUT the caring and loving help from You.

Please, I don’t know if you have families, sons, daughters, Wifes, but Please think if something like this would happen to your children. Or one of your loved ones. (God forbid)
Please think of that, and think of the family that THIS has happened to, they have lost their beloved daughter, she was only 30 years old.
She fell in love with Scotland and she died during very mysterious circumstances in the arms of your beautiful country.

Please help Annies family to get the truth.

They told us, that they should not investigate what happened to Annie after 16.05, when she was last spotted on the CCTV camera at Station Road in Prestwick.

Why?
