Injustices In Scotland.
I am Interested in finding out about fights for Justice in Scotland and in particular the experiences of people trying to engage the help of MSPs and in particular i want to know the ones who have bothered to help and others who just didn't want to know anything about it.
Has anyone had bad dealings with SCCRC, If so let us know?
Having suffered a miscarriage of Justice at the hands of our Justiciary Twisted Evil I am still fighting after 25 years to just have a proper Appeal (Which i have never had Sad )

WULLIE I AGREE, THERE IS MORE INJUSTICE IT HAPPENS EVERYDAY. WHERE IS THE RIGHTS OF ANY OF US IN SCOTLAND GONE ? JUST A THOUGHT IF YOU ADMIT A CRIME THAT YOU DID YOUR LOOKED AFTER WELL DENY YOUR IN DENIAL.AND HAVE YEARS OF PAIN INSIDE THEN IF YOUR ALIVE AFTER 30 YEARS THROWN ON THE STREETS FEND FOR YOUR SELFS IS THE MENTALITY THERE ARE NO HELP NO SUPPORT, LAWYERS LOL ALL PART OF THE JUSTICE SYSTEM.

It would seem i have been reliably informed that the Killie 2 were convicted on hearsay evidence.
Brendan Dixon's Family protest that he was with them on the day in Question, Yet this Hearsay evidence was enough to put him behind bars with the recommendation of 25 years. TC Campbell comes to mind with the evidence of William Love.
SCCRC have stated: That hearsay evidence is not Admissible in Court so at the very least they have an appeal to them if their appeal is rejected.
I will do my best to publish the view of SCCRC or at least link it to this forum.
Maybe they meant only in my case it isn't admissible.
I have always been led to believe that this evidence is admissible but under stringent Guidelines Only, and strong directions from the Judge.
Any other comments on this is more than welcome

I feel the need to post the Current Law Policy of SCCRC and their findings in regards to the conduct of my ID Parade, Please find links below.

The SCCRC & Current Law
The Commission sometimes receives applications which relate to convictions imposed at a time when the law on a given point was different from the law currently applying.

The question, therefore, arises as to whether to refer a case to the High Court on the basis that the court should apply the law as at the date of the hearing of the appeal by the High Court after referral by the Commission, rather than at the date of the conviction.
After one such case was referred by the Commission to the High Court, the court's decision was that it would deal with the case on the basis of the law as it is currently stood and not as it existed at the time when the applicant was convicted. The court expressed the view that cases should be examined in the light of existing law and standards. Accordingly, it is on this basis that the Commission approaches its enquiries. Maybe Iain can help with the above enquiry into the conduct at my ID Parade with him being Ex Police.
In 1981 was it allowed for the arresting officers to assist with witnesses at any ID Parade.
One in my case assisted and one was present in the parade room, Dickson and Peacock were both arresting officers, see flickr site linked for ID Parade report.
See also Shaws report in which he has Muckle (Police) had number two out his mouth before turning to view parade.

It would seem that these police also turn on their own, They would appear to have no scruples about who they set up.
I wonder if in light of Tamby's statement there will be further Enquiries now made? although i doubt this very much.

Re identity parades. There are strict rules governing police identity parades. For instance the accused is entitled to have his/her lawyer present while witnesses are viewing to avoid just the sort of bias you are outlining.

Identity parades have often been criticised with allegations of influencing witnesses fairly common.

New ways, e.g. video parades, are being introduced.
