Iain, i have followed this case and it stinks to high heaven.
it seems the judges in south africa are just as bad as some of our's.

i hope justice will be done and mr van der vyver's gets the verdict of not guilty and there for does not become another case of miscarraige of justice.

Appalling Case

As with so many cases in Scotland we have Fabrication, Police lies, improper investigations with contamination of evidence and evidence not being gathered properly.
Sounds just like many on these forums we are continually reading of.
Only through the internet are people now starting to take notice but also people are starting to now find help like, Independent fingerprint experts etc etc which would never have been available before.
Our Defence teams are guilty of not wanting to spend too much money asking for American experts to come to Scotland, Very rarely does this happen in our courts.
Very rarely would people have questioned these experts in Scotland The case of Shirley McKie has highlighted that not only should they be challenged but in the case of Fiona McBride, Who not only signed her own Signature on Shirley's Mistaken Print but She signed another two experts signature's.
To me she should have been charged with Fraud and sent to prison as would happen with anyone convicted of such a crime.
What happened to her? She was asked to resign to save the blushes of our SCRO.
Will anyone ever have the gall to stand and challenge her for this crime?
It also makes one wonder.....
How many times did this so called expert sign her Colleagues names on other fingerprints?
How many times did this also go Unchallenged?

Fingerprint

Of course the police might now try and say they are mistaken the same as Shirley McKie's case.
No fingerprint on DVD no case to answer since he was her boyfriend he would have used Glasses in the flat.
Shocking Shocking that this is happening worldwide and not confined to SCRO
I wonder if like Fiona McBride did with Shirley's case, Did anyone sign another experts signature.
For those who dont know where i am coming from..... Fiona McBride signed another two experts signatures as having looked at the Y7 Shirley McKie wrong Print.
She should be charged with Perverting the course of Justice or Perjury at the very least.
It also begs the question....... How many times has this been done in the past ans went unchallenged, I mean even Iain McKie doubted his Daughter because for 30 years as a policeman he thougt Prints were infallible.

The spectre of criminality and/or incompetence at police and expert level is certainly not confined to Scotland. This case is raising some extremely serious questions about South African justice and if the fingerprint evidence is anything to go by the Police and the State have a lot of answering to do.

Having heard from internationally renowned experts like Pat Wertheim and Arie Zeelenberg that dishonesty by Police and forensic services is a possibility I await the coming weeks evidence with interest.

In the meantime while I do not know for certain that Fred van der Vyver is innocent of this terrible crime (that judgement is the courts) I can and do believe that he is.

The belief of others is extremely important to those who have suffered injustice and I hope that readers will come forward with support for Fred's family as they face another week in court hoping for justice but with always the nagging fear that it could yet be denied.

Although care must be taken in reaching conclusions based on media reports this latest article gives an insight into the many issues that are surfacing as the prosecution case is subject to dissection.

This week will see more expert evidence led to refute the prosecution's case.

A very Intriguing case and one which must bring back sore memories of Shirleys though not identical the key issue is a fingerprint, and disputed one at that.

This South African case bears a remarkable similarity to a miscarriage of justice that happened in England.

In June 2001, Alan McNamara a Bolton businessman was jailed for 30 months at Manchester Crown Court.

'The trial was told his thumbprint was found on a jewellery box at the burgled Rochdale home.

But he believes his print was actually found on a vase or other item which was bought from his discount shop.

Experts have backed his claim, saying the thumbprint has no marks consistent with being taken from a wooden jewellery box.

Instead, they believe it came from a smooth, curved surface, such as a vase which was sold at Mr McNamara's shop.'
