Kevin McLeod
According to Northern Constabulary, Kevin and his friend arrived at Carters Bar sometime around 10.30pm where they enjoyed a few drinks. At closing time the two friends went to the Waterfront Night Club to continue the night's enjoyment. At around 1.30am a known male struck Kevin on the face. It seems there were no further incidents within the club.
At about 2.30am Kevin and his pal left the club, joined two girls in a taxi and headed to a party. For some reason they never went into the party and headed off to an all night bakery in the area. At this point Kevin began to feel ill, clutching his stomach, crouching and vomiting. Kevin then stumbled then fell heavily but nevertheless seemed uninjured. This was witnessed by a police officer who decided it did not warrant intervention. The friends continued to Market Square where Kevin's friend spoke to a taxi driver, meantime Kevin sat on a windowsill of a local shop clearly suffering pain in his abdomen. Kevin then stumbled off toward the harbour where he was seen by two police officers on the Service Bridge they noted that Kevin was staggering. Other witnesses saw Kevin staggering and clutching his stomach. The night watchman at the harbour saw Kevin crouched down clutching his stomach on the pavement, adjacent to the harbour wall. 15 minutes later he saw Kevin still crouched down in the same position. A further witness also saw Kevin, spoke to him but got no response. One hour later the night watchman noted Kevin was gone.
When Kevin failed to return home his family reported him missing. On Sunday 9th February 1997, Kevin was found by a police diver in the waters of the harbour. Police reported to the family that Kevin had drowned.
The subsequent post mortem report revealed that Kevin had sustained what appeared to be serious and of themselves, highly unusual abdominal injuries. The opinion that was expressed to the police in attendance was the possibility they had been the result of an assault and almost certainly occurred prior to Kevin having been immersed in the waters of Wick Harbour. The Procurator Fiscal (PF) at Wick was advised accordingly. The PF then advised Northern Constabulary that this was now a potential Murder Enquiry and should be treated as such. The phrase used was "the full works".
The "full works" as far as can be determined, notwithstanding the fact that the subject of the investigation was potentially the commission of a crime of murder, consisted of :
A lack of involvement of senior officers
A lack of door to door enquiries
A lack of enquiries to locate and identify potential witnesses
Neglect? Too many people involved to be neglect.
SO WHAT HAPPENED TO KEVIN?
Theory number one. The abdominal injuries were consistent with Kevin having collided with an ornamental bollard located at the harbour side.
Theory number two. The assumption that Kevin had fallen to the deck of the Gunnhilda.
Theory number three. An autopsy photograph emerges showing a diamond like pattern on Kevin's body. The opinion then formed that these marks bore a close resemblance to the net weave pattern found on lobster creels located on the deck of the Aroura, berthed next to the Gunnhilda. An accidental death.
Hold it. Hold it.
A Fatal Accident Inquiry at Wick concluded that the injuries were sustained, probably about an hour before Kevin entered the water. The severity was such that if untreated they would have proved fatal and even if prompt surgical intervention had been available, survival would have been uncertain. They were compatible with the deceased having been assaulted by a person or persons unknown with great force such as kicking or kneeing. They were also compatible with the deceased having collided accidentally but with great force against some object. It is probable that the deceased while affected by alcohol and suffering pain from his injuries experienced an urge to urinate, lost his balance and fell into the water.
Check this out.
Kevin's movements that night were compiled following the result of police enquiry. These enquiries had Kevin stumbling around, falling over, clutching his abdomen in obvious pain and distress, resting on windowsills, falling against a shop window all before he was in the harbour area. An obvious indication that he had sustained his injuries before he was near the harbour. It is worthy of note that a leading Home Office Pathologist who was shown the diamond pattern of injuries showed no hesitation in saying, " I've seen this type of pattern before. They are the same pattern shoe laces would make." So was Kevin kicked somewhere between leaving the taxi and walking to the bakery? Makes a bit more sense than falling on to creels on the deck of the Aurora particularly when the skipper insists there were no creels in use on his boat at that time.
Does not look like an accident anymore..... Does it?

After a long and protracted fight Kevin's family eventually made a successful appeal to the Scottish Information Commissioner forcing release the (heavily edited) report by Central Scotland Police into the handling of a series of complaints against Northern Constabulary by the McLeod family

I am sure every one on this forum will join me in wishing this family some Luck and best wishes in their quest for justice.
Today they met with an independent police complaints commissioner.
We also hope that he looks independently and impartialy into all the issues raised by the McLeod's including why their 26 or so complaints, Were they claim, put in the BIN. Past experiences with these people have always proven them to not be as independent as they make out but lets hope that with a new Government comes a new and impartial Independent complaints commission throughout our Judiciary as a whole.

Commissioner to look into McLeod grievances

THE McLeod family from Wick yesterday began a new phase in their "Justice for Kevin" campaign.
They are seeking to bring Northern Constabulary to book for how it investigated the suspicious death of Kevin McLeod over 10 years ago.
No final conclusions have been drawn on how Kevin came to end up drowning in the town's harbour after a night out with friends. Police say two inquiries revealed no evidence to charge anyone over the 24-year-old's death.
But Kevin's family accuse the force of initial incompetence and subsequent cover-up in the way it has acted.
Their concerns over how the initial probe was carried out have been shared by the sheriff who conducted the fatal accident inquiry and in the findings of a report into how the force handled the family's complaints.
Yesterday, Kevin's parents, Hugh and June McLeod, and uncle Allan McLeod, who lives in Alness, met Scottish Police Complaints Commissioner Jim Martin.
They are hoping Mr Martin, a former teachers' union leader, will take forward the central grievances they have with Northern Constabulary.
Speaking after the two-hour meeting yesterday afternoon, Allan McLeod said: "We hope the commissioner will take on board our complaints and be open and impartial.
"We had a very open meeting and he has assured us that he will look into our grievances and will have another face-to-face meeting with us to tell us what his conclusions are.
"We have been asking Northern Constabulary for 10 years the answers to our questions and they have blatantly refused to address them. We're hoping now that the commissioner can come back to us and finally give us some answers."
He continued: "We want to know why, when Kevin's death was treated as a murder inquiry, police blatantly broke just about every basic procedure in the book."
Mr McLeod claimed the major shortcomings were failures to:
Enlist extra resources.
Conduct door-to-door enquiries.
Cordon off or search the area where Kevin was last seen.
Trace a named possible suspect.
Inform the family that Kevin's death was being treated as murder.
Tell the family of Kevin's massive abdominal injuries.

The family also continue to be puzzled over why police destroyed Kevin's clothing soon after his body was recovered. They are convinced Kevin was brutally beaten up shortly before ending up in the water.
Mr McLeod told Mr Martin that Northern Constabulary has ignored the battery of 26 complaints tabled about the initial investigation.
"Our complaints were neither recorded nor registered. They were, as far as we're concerned, put in the bin."
The file is one of the first taken on by Mr Martin's office since it was created earlier this year. The family believe it is a test case.
"I'm sure all of Scotland will be watching this case very closely," said Allan McLeod. "But you have to bear in mind that his remit allows him only to look at how Northern Constabulary handled our complaints.
"It doesn't allow him to investigate them."
Mr McLeod said this is why the family have been campaigning for an independent police ombudsman who would have more wide-ranging powers.
Mr Martin was accompanied by his office director Elisabeth Stark. They refused to speak to the press while their investigation is in progress.
As part of their probe, they are due in Inverness today to meet the Northern Joint Police Board and Northern Constabulary's Chief Constable Ian Latimer. |

We the Family of the Late Kevin Mcleod Live in hope but Fear that those people who we suspect from the outset was responsible for Murdering Kevin may "Never be brought to Justice" due to who we suspect was involved in this Horrific crime and to the the protection we suspect is being provided to "all" of them by the Authorities.
Northern Constabularys "Seriously Flawed Murder Enquiry" when Investigating Kevins horrific death without doubt must include the Criminal Charges of, "Culpable Neglect of Duty" and "Fabrication of Evidence".
We the family along with other Professional bodies suspect that there are retired and serving "Public Servants" who from the outset knew what happened that fateful night and who was responsible for Murdering Kevin, but have chosen to remain silent to cover-up for "all" those involved.
We have Documented Evidence that Kevins case involved Corruption, Conspiracy, Collusion and Subsequent Cover-ups which we suspect was to protect those involved and to protect the Credibility and Reputation of the Authorities.

We Suspect that Kevin was at the wrong place at the wrong time, that he was viciously attacked, kicked to death, Murdered then put in the harbour to make it appear as an Accidental death.
We also suspect that there are other people who know about or witnessed this horrific crime but are frightened to come forward in fear of reprisals or not being believed by the Authorities.
For 10 years The Authorities have undertaken numerous Delaying Tactics and Erected Barriers to try and drain the family Financially, Mentally and Physically in the hope we would go away by insisting that Kevins death was Accidental, But rest assured their plan has Failed Dramatically. We will continue our fight at least until the truth is exposed as to Why the Authorities Failed to properly Investigate Kevins death, our Complaints and who really did Murder Kevin.
Kevins case is not just about Negligence Inexperience or Incompetence, There is to many people involved for that, Its about Corruption,Conspiracy, Collusion amd Cover -ups at its highest Level by "all" the Authorities.
These Failings by police was at best (a) Gross Negligence of the Worst Kind,or (b) A Cover-up for Someone or Something more Sinister.
There is just no other way to see it.
Chief Constable Andrew Camereon in His £292.000.00 so called "Independent" report submitted in 2002 which Northern Constabulary refused to release, but which we obtained a redacted copy through the FOI made a recommendation that the police board in conjunction with Northerns Chief Constable consider an "Apology" for the distress and inconvenience experienced by the family in consequence of the forces shortcomings. We received "No Apology".
This case has without doubt from the outset been a Massive Cover-up, but also a Huge Injustice for Kevin and the family and which has no doubt has left those Authorities for whom we the Family and the Public should Respesct and Trust, with Blood on their hands and a Very Guilty Conscience.

The case of Kevin MacLeod is an extremely important one containing all the elements that so stain Scottish Justice today.
Despite its importance I suspect the mass of information posted might have proved a turn off to the casual visitor. Please remember less is often more and many people don’t read long postings that lack clarity.
Would it be possible to provide a short 1 page summary for the Case Studies Section and also a posting on where the case is at the moment.

I was privileged to attend yesterdays meeting between the June, Hugh and Allan McLeod and Chief Constable Latimer in Wick. Family friend Keith, the convener of Northern Joint Police Committee Norman McLeod and various police officers also attended.
Mr. Latimer’s unconditional apology was accepted by the family and two hours of useful discussion chaired by local MP Lord John Thurso ensued.
I was greatly impressed by the dignity and restraint shown by the McLeods throughout this meeting and it is to their credit that despite the anger and frustration of the past 10 years they were able to bring this part of the saga to an end.
The remaining sticking point appears to be their request for a review of the police investigation. Given that so many errors were made in other areas of the police response to Kevin’s death their total lack of faith in the police must be recognised by the police chief. The independent review is essential if this running sore is ever to be healed and Northern Constabulary’s reputation is to be restored.
We await Mr Latimer's decision with interest. |

Great to see you were able to assist in this case, I feel your presence at such a meeting would have made people like Mr Latimer take more notice.
I also feel he knows that you are aware of how things should have been done but weren't and he will therefore not be able to pull the wool over your eyes as much as someone not in possesion of your knowledge of the Law and inner workings.
Please continue your great work, It is much appreciated without a shadow of doubt

This Web-site has today completed the survey in respect of matters arising from the delay in responding to the Macleods from Wick.
The web-site has recorded 73% now in favour of the resignation of Ian Latimer.
Further concerns also relate to the lack of progress in the matter of Kevin Gillies a young man whose parents are still without answers after eight years .
The survey reflected that these situations were unacceptable and that prompt action is vital.
A legal source has stated that the Chief Constable may be acting unlawfully and to that end a legal opinion is being prepared with a view to its submission at the Supreme Court

Chief Supt Bruce Duncan has today told the web-site that he will speak to David 0 Conner and Chief Supt Laurie Stewart about blackmail and corruption by Inspector Angus aka Gus Macpherson.
Mr Duncan claims that he has a son who is in the police force in Edinburgh and that like The Macleods of Wick he would not want his son to be beaten and thrown in the water.He states" what can he do "and supports The Chief Constable in his actions.
The web-site holds Mr Duncan to be sarcastic and completely disingenuous when dealing with complaints. |
